An act relating to college campus facilities in areas 2 
of critical state concern; amending s. 1009.23, F.S.; 3 
revising the authorized uses of revenue from capital 4 
improvement fees to include certain college campus 5 
facilities in areas of critical state concern; 6 
amending s. 1013.40, F.S.; revising the number of beds 7 
certain Florida College System institutions may 8 
provide to certain persons; authorizing such beds to 9 
be provided to health care workers; revising which 10 
funds may be used for specified purposes relating to 11 
such dormitories; requiring the Division of Bond 12 
Finance to conduct an analysis of financing before the 13 
issuance of specified bonds; providing an effectiv e 14 
date. 15

Be It Enacted by the Legislature of the State of Florida: 17 
 18 
 Section 1.  Paragraph (f) is added to subsection (11) of 19 
section 1009.23, Florida Statutes, to read: 20 
 1009.23  Florida College System institution student fees. — 21 
 (11) 22 
 (f)  Capital improvement fee revenues may be used for the 23 
purposes authorized in s. 1013.40(4). 24

Statutes, is amended to read: 26 
 1013.40  Planning and construction of Florida College 27 
System institution facilities; property acquisition. — 28 
 (4)(a) The campus of a Florida College System institution 29 
within a municipality designated as an area of critical state 30 
concern, as defined in s. 380.05, and having a comprehensive 31 
plan and land development regulations containing a building 32 
permit allocation system that limits annual growth, may 33 
construct dormitories for up to 340 beds for Florida College 34 
System institution students, and an additional 50 25 beds for 35 
employees, educators, health care workers, and first responders. 36 
Such dormitories are exempt from the building permit allocation 37 
system and may be constructed up to 60 feet in height if the 38 
dormitories are otherwise consistent with the comprehensive 39 
plan, the Florida College System institution has a hurricane 40 
evacuation plan that requires all dormitory occupants to be 41 
evacuated 48 hours in advance of tropical force winds, and 42 
transportation is provided for dormitory occupants during an 43 
evacuation. 44 
 (b) State operating funds, state performance funds, and 45 
tuition and fee revenues collected from the tuition, out -of-46 
state fee, activity and service fee, financial aid fee, 47 
technology fee, and distance learning fee may not be used for 48 
construction, debt service payments, maintenance, or operation 49 
of such dormitories. 50

 (c)  Grants and donations for capital outlay and revenues 51 
from the capital improvement fee may be used for construction, 52 
debt service payments, maintenance, or operation of such 53 
dormitories. 54 
 (d) Additional dormitory beds constructed after July 1, 55 
2016, may not be financed through the issuance of bonds by the 56 
Florida College System institution; however, bonds may be issued 57 
by nonpublic entities as part of a public -private partnership 58 
between the college and a nonpublic entity. Before the issuance 59 
of any such bonds, the Division of Bond Finance shall analyze 60 
the financing and any issues raised by such analysis must be 61 
appropriately considered by the college. 62 
 Section 3.  This act shall take effect July 1, 2024. 63
