Subsection (4) of section 790.15, Florida 10 Statutes, is amended to read: 11 790.15 Discharging fir earm in public or on residential 12 property.— 13 (4)(a) Any person who recreationally discharges a firearm 14 outdoors, including target shooting, in an area that the person 15 knows or reasonably should know : 16 1. Is primarily residential in nature ; or and that has a 17 residential density of one or more dwelling units per acre , 18 2. Has a residential density of 1.25 or more acres per 19 dwelling unit and the firearm discharge by the person does not 20 remain within the boundaries of the property in which the 21 discharge takes place, 22 23 commits a misdemeanor of the first degree, punishable as 24 provided in s. 775.082 or s. 775.083. 25 HB 259 2024 CODING: Words stricken are deletions; words underlined are additions. hb0259-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (b) This subsection does not apply : 26 (a) to a person lawfully defending life or property or 27 performing official duties requiring the discharge of a firearm; 28 (b) If, under the circumstances, the discharge does not 29 pose a reasonably foreseeable risk to life, safety, or property; 30 or 31 (c) To a person who accidentally discharges a firearm . 32 Section 2. This act shall take effect October 1, 2024. 33
