HB 293 2024 CODING: Words stricken are deletions; words underlined are additions. hb0293-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to hurricane protections for 2 homeowners' associations; amending s. 720.3035, F.S.; 3 providing applicability; requiring the board or a 4 committee of a homeowners' association to adopt 5 hurricane protection specifications; requiring that 6 such specifications conform to applicable building 7 codes; prohibiting the board or a committee of an 8 association from denying an application for the 9 installation, enhancement, or replacement of certain 10 hurricane protection; authorizing the requirement to 11 adhere to certain guidelines regarding the external 12 appearance of a structure or an improvement on a 13 parcel; defining the term "hurricane protection"; 14 providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Subsection (6) is added to section 720.3035, 19 Florida Statutes, to read: 20 720.3035 Architectural control covenants; parcel owner 21 improvements; rights and privileges. — 22 (6)(a) To protect the health, safety, and welfare of the 23 people of the state and to ensure uniformity and consistency in 24 the hurricane protection installed by parcel owners, this 25 HB 293 2024 CODING: Words stricken are deletions; words underlined are additions. hb0293-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S subsection applies to all homeowners' associations in the state, 26 regardless of when the community was created. The board or any 27 architectural, construction improvement, or other such similar 28 committee of an association must adopt hurricane protection 29 specifications for each structure or other improvement on a 30 parcel governed by the association. The specifications may 31 include the color and style of hurricane protection products and 32 any other factor deemed relevant by the board. All 33 specifications adopted by the board must comply with the 34 applicable building code. 35 (b) Notwithstanding any other provision in the governing 36 documents of the association, the board or any architectural, 37 construction improvement, or other such similar committee may 38 not deny an application for the installation, enhancement, or 39 replacement of hurricane pro tection by a parcel owner which 40 conforms to the specifications adopted by the board or 41 committee. The board or committee may require a parcel owner to 42 adhere to an existing unified building scheme regarding the 43 external appearance of the structure or other improvement on the 44 parcel. 45 (c) For purposes of this subsection, the term "hurricane 46 protection" includes, but is not limited to, metal roofs, 47 permanent fixed storm shutters, roll -down track storm shutters, 48 impact-resistant windows and doors, polycarbona te panels, 49 reinforced garage doors, erosion controls, and other hurricane 50 HB 293 2024 CODING: Words stricken are deletions; words underlined are additions. hb0293-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S protection products used to preserve and protect the structures 51 or improvements on a parcel governed by the association. 52 Section 2. This act shall take effect upon becoming a law. 53
