A bill to be entitled 1 
An act relating to traveling across county lines to 2 
commit criminal offenses; amending s. 843.22, F.S.; 3 
deleting the definition of "burglary"; providing for 4 
reclassification of certain offenses if the person who 5 
commits the offense travels with the intent to commit 6 
the offense in a county other than the person's county 7 
of residence; providing an effective date. 8

Be It Enacted by the Legislature of the Stat e of Florida: 10 
 11 
 Section 1.  Section 843.22, Florida Statutes, is amended to 12 
read: 13 
 843.22  Traveling across county lines with intent to commit 14 
certain offenses a burglary.— 15 
 (1)  As used in this section, the term : 16 
 (a) "county of residence" means the co unty within this 17 
state in which a person resides. Evidence of a person's county 18 
of residence includes, but is not limited to: 19 
 (a)1. The address on a person's driver license or state 20 
identification card.; 21 
 (b)2. Records of real property or mobile home ow nership.; 22 
 (c)3. Records of a lease agreement for residential 23 
property.; 24 
 (d)4. The county in which a person's motor vehicle is 25

registered.; 26 
 (e)5. The county in which a person is enrolled in an 27 
educational institution .; and 28 
 (f)6. The county in which a person is employed. 29 
 (b)  "Burglary" means burglary as defined in s. 810.02, 30 
including an attempt, solicitation, or conspiracy to commit such 31 
offense. 32 
 (2)  If a person who commits a grand theft or a forcible 33 
felony, as defined in s. 776.08, burglary travels any distance 34 
with the intent to commit the offense burglary in a county in 35 
this state other than the person's county of residence, the 36 
degree of the offense burglary shall be reclassified to the next 37 
higher degree. For purposes of sentencing under cha pter 921 and 38 
determining incentive gain -time eligibility under chapter 944, 39 
an offense a burglary that is reclassified under this section is 40 
ranked one level above the ranking specified in s. 921.0022 or 41 
s. 921.0023 for the offense burglary committed. 42 
 Section 2.  This act shall take effect upon becoming a law. 43
