HB 535 2024 CODING: Words stricken are deletions; words underlined are additions. hb0535-00 Page 1 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to low -voltage alarm system projects; 2 amending s. 553.793, F.S.; specifying that a 3 nonelectric fence or wall must enclose the outside 4 perimeter of a low-voltage electric fence; permitting 5 low-voltage electric fences to be installed in areas 6 within more than one zoning category; prohibiting a 7 municipality, county, district, or other entity of 8 local government from adopting or maintaining certain 9 ordinances or rules that provide additional 10 requirements for low -voltage alarm system projects; 11 providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Paragraphs (b) and (d) of subsection (3) and 16 subsection (10) of section 553.793, Florida Statutes, are 17 amended to read: 18 553.793 Streamlined low -voltage alarm system installation 19 permitting.— 20 (3) A low-voltage electric fence must meet all of the 21 following requirements to be permitted as a low -voltage alarm 22 system project, and no further permit shall be required for the 23 low-voltage alarm system project other than as provided in this 24 section: 25 HB 535 2024 CODING: Words stricken are deletions; words underlined are additions. hb0535-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (b) A nonelectric fence or wall must completely enclose 26 the outside perimeter of the low-voltage electric fence. The 27 low-voltage electric fence may be up to 2 feet higher than the 28 perimeter nonelectric fence or wall. 29 (d) A The low-voltage electric fence is allowed shall not 30 be installed in any an area unless the area is zoned exclusively 31 for single-family or multifamily residential use. An area is not 32 considered to be zoned exclusively for single -family or 33 multifamily residential use if the area is within more than one 34 zoning category. 35 (10) A municipality, county, district, or other entity of 36 local government may not adopt or maintain in effect any 37 ordinance or rule regarding a low -voltage alarm system project 38 that provides additional requirements beyond those set out in 39 this section for the installation or maintenance of a low -40 voltage alarm system project o r that is otherwise is 41 inconsistent with this section. 42 Section 2. This act shall take effect July 1, 2024. 43
