A bill to be entitled 1 
An act relating to in -store servicing of alcoholic 2 
beverages; amending s. 561.424, F.S.; revising 3 
applicability of provisions regulating in -store 4 
servicing of wine to include products with a specified 5 
percentage of alcohol; authorizing the Division of 6 
Alcoholic Beverages and Tobacco of the Department of 7 
Business and Professional Regulation to adopt rules; 8 
providing an effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11 
 12 
 Section 1.  Subsection (2) of section 561.424, Florida 13 
Statutes, is amended, and subsections (3) and (4) are added to 14 
that section, to read: 15 
 561.424  Vinous and other beverages; in-store servicing 16 
authorized.— 17 
 (2)  Nothing in s. 561.42 or any other provision of the 18 
alcoholic beverage law prohibits shall prohibit a distributor of 19 
wine from providing in -store servicing of wine sold by the such 20 
distributor to a vendor. As used in this section, the term "in-21 
store servicing" as used herein means: placing the wine on the 22 
vendor's shelves and maintaining the appearance and display of 23 
the said wine on the vendor's shelves in the vendor's licensed 24 
premises; placing the wine that is not so shelved or displayed 25

in a storage area designated by the vendor, which is located in 26 
the vendor's licensed premises; rotation of vinous beverages; 27 
and price stamping of vinous beverages in the vendor's licensed 28 
premises. This section shall not apply to distilled spirits. 29 
 (3)  This section does not apply to distilled spirits, but 30 
specifically applies to products containing less than 6 percent 31 
alcohol by volume as described in s. 564.06(5)(b). 32 
 (4)  The division may adopt rules to implement this 33 
section. 34 
 Section 2.  This act shal l take effect July 1, 2024. 35
