An act relating to in -store servicing of alcoholic 2
beverages; amending s. 561.424, F.S.; conforming 3
provisions to changes made by the act; creating s. 4
561.425, F.S.; authorizing the in -store servicing of 5
distilled spirits sold by a distributor to a vendor; 6
defining the term "in -store servicing"; providing an 7
effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section 1. Subsection (2) of section 561.424, Florida 12
Statutes, is amended, and subsection (3) is added to that 13
section, to read: 14
561.424 Vinous beverages; in -store servicing authorized. — 15
(2) Nothing in s. 561.42 or any other provision of the 16
alcoholic beverage law prohibits shall prohibit a distributor of 17
wine from providing in -store servicing of wine sold by the such 18
distributor to a vendor. 19
(3) As used in this section, the term "in-store servicing" 20
as used herein means: 21
(a) Placing the wine on the vendor's sh elves and 22
maintaining the appearance and display of the said wine on the 23
vendor's shelves in the vendor's licensed premises .; 24
(b) Placing the wine that is not so shelved or displayed 25

in a storage area designated by the vendor, which is located in 26
the vendor's licensed premises .; 27
(c) Rotating rotation of vinous beverages.; and 28
(d) Price stamping of vinous beverages in the vendor's 29
licensed premises. This section shall not apply to distilled 30
spirits. 31
Section 2. Section 561.425, Florida Statutes, is created 32
to read: 33
561.425 Distilled spirits; in -store servicing authorized. - 34
(1) Nothing in s. 561.42 or any other provision of the 35
alcoholic beverage law prohibits a distributor of distilled 36
spirits from providing in -store servicing of distilled spiri ts 37
sold by the distributor to a vendor. 38
(2) As used in this section, the term "in -store servicing" 39
means: 40
(a) Placing distilled spirits, including distilled spirits 41
located in a storage area designated by the vendor, on the 42
vendor's shelves and mainta ining the appearance and display of 43
the distilled spirits on the vendor's shelves in the vendor's 44
licensed premises. 45
(b) Placing the distilled spirits in displays. 46
(c) Placing the distilled spirits that are not shelved or 47
displayed in a storage area designated by the vendor, which is 48
located in the vendor's licensed premises. 49
(d) Rotating distilled spirits. 50

(e) Price stamping distilled spirits in the vendor's 51

Section 3. This act shall take effect July 1, 2024. 53
