HB 741 2024 CODING: Words stricken are deletions; words underlined are additions. hb0741-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to the Town of Hillsboro Beach, 2 Broward County; requiring the Division of Alcoholic 3 Beverages and Tobacco of the Department of Business 4 and Professional Regulation to issue a special 5 alcoholic beverage license to a residential 6 condominium that meets certain requirements; limiting 7 the issuance of such license and the provision and 8 sale of alcoholic beverages under such license; 9 authorizing the division to regulate and supervise 10 residential condominiums to which such licenses have 11 been issued; authorizing the division to revoke or 12 suspend such licenses under certain circumstances; 13 providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. (1) Notwithstanding s. 561.20(2), Florida 18 Statutes, or any other provision of law, the Division of 19 Alcoholic Beverages and Tobacco of the Department of Business 20 and Professional Regulation shall issue a special al coholic 21 beverage license to a residential condominium in the Town of 22 Hillsboro Beach, Broward County, which: 23 (a) Has no fewer than 50 condominium units in a single 24 building or multiple buildings under the control and operation 25 HB 741 2024 CODING: Words stricken are deletions; words underlined are additions. hb0741-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S of the same association of condominium owners. 26 (b) Is wholly owned by or rented to nontransients. 27 (c) Is licensed as a food service establishment under 28 chapter 381 or chapter 509, Florida Statutes, and regularly 29 offers food and beverage amenities to condominium residents. 30 (2) A special alcoholic beverage license issued under this 31 section: 32 (a) Shall be issued only to the person, company, or 33 corporation that manages the food and beverage operations of the 34 condominium and not to the association of condominium owners. 35 (b) Is limited to the provision of alcoholic beverages for 36 consumption on the premises only to residents of the condominium 37 and their nonresident guests. 38 (c) Does not authorize the condominium to sell alcoholic 39 beverages by the package for off -premises consumption or to sell 40 alcoholic beverages after the hours of serving or consumption of 41 food have elapsed. 42 (3) The Division of Alcoholic Beverages and Tobacco of the 43 Department of Business and Professional Regulation may regulate 44 and supervise residential condomin iums to which special 45 alcoholic beverage licenses have been issued under this section 46 in accordance with the rules of the division and general law not 47 inconsistent with this section. This act shall take effect upon becoming a law. 52
