A bill to be entitled 1 
An act relating to Lee County; amending chapter 98 -2 
461, Laws of Florida; revising the boundaries of the 3 
Lee County Mosquito Control District; repealing 4 
chapter 2001-335, Laws of Florida, relating to the 5 
Fort Myers Beach Mosquito Control District; providing 6 
for merger of the districts; transferring assets and 7 
liabilities; requiring a referendum; providing 8 
effective dates. 9

Be It Enacted by the Legislature of t he State of Florida: 11 
 12 
 Section 1.  Section 1 of chapter 98 -461, Laws of Florida, 13 
is amended to read: 14 
 Section 1.  Continuation of a mosquito control district. —15 
There is hereby provided for the continuation of the Lee County 16 
Mosquito Control District, an independent special district, the 17 
boundaries of which shall include all territory of Lee County . 18 
except the following described area: 19

A tract or parcel of land lying in parts of Township 23 
46 South, Range 24 East and Township 46 South, Range 24 
24 East and part of Township 47 South, Range 24 East, 25

Lee County, Florida, which tract or parcel, containing 26 
14,615 acres more or less, is described as follows: 27

BEGINNING at the southeast corner of Section 24, 29 
Township 46 South, Range 24 East, running west erly 30 
along the south line of said section for 2,700 feet 31 
more or less to the waters of Estero Bay; 32 
 33 
THENCE run southwesterly along a northwesterly line 34 
across the waters of Estero Bay for 8,300 feet to a 35 
point of intersection; 36

THENCE run southerly along a westerly line across said 38 
Bay and Starvation Flats for 4,200 feet more or less 39 
to a point of intersection; 40

THENCE run southeasterly, southerly and southwesterly 42 
along a westerly line of said area running across said 43 
Bay and Big Carlos Pass for 10,000 fee t more or less; 44

THENCE run northwesterly across Big Carlos Pass and 46 
along the shoreline of Estero Island for 6,100 feet 47 
more or less to a point of intersection; 48

Myers Beach Mosquito Control District is merged into the Lee 76 
County Mosquito Control District. All assets and liabilities of 77 
the Fort Myers Beach Mosquito Control District as of that date 78 
shall be transferred to the Lee County Mosquito Control 79 
District. 80 
 Section 4.  Referendum.— 81 
 (1)  The referendum electi on called for by this act shall 82 
be held on November 5, 2024, concurrent with the 2024 general 83 
election. 84 
 (2)  The ballot title for the referendum question shall be 85 
in substantially the following form: 86 
REVISING BOUNDARIES OF LEE COUNTY MOSQUITO CONTROL 87 
DISTRICT TO INCLUDE ALL OF LEE COUNTY 88 
 (3)  The referendum question shall be placed on the ballot 89 
in substantially the following form: 90 
Shall Chapter 2024-  , Laws of Florida, amending the 91 
boundaries of the Lee County Mosquito Control District 92 
to include all of Lee County, abolishing the Fort 93 
Myers Beach Mosquito Control District, and 94 
transferring the assets and liabilities of the Fort 95 
Myers Beach Mosquito Control District to the Lee 96 
County Mosquito Control District, become effective? 97 
(    )  YES. 98 
(    )  NO. 99 
 (4)  In the event this question is answered affirmatively 100

by a majority of the qualified voters voting in the referendum, 101 
this act shall take effect. The referendum election shall be 102 
conducted by the Supervisor of Elections of Lee County in 103 
accordance with the Florida Election Code. 104 
 Section 5.  This act shall take effect only upon its 105 
approval by a majority vote of those qualified electors of Lee 106 
County voting in a referendum conducted in accordance with the 107 
provisions of law relating to elections curren tly in force, 108 
except that this section and section 4 shall take effect upon 109 
becoming a law. 110
