Subsection (8) is added to section 626.171, 16 Florida Statutes, as amended by HB 98 9 or similar legislation, 17 2024 Regular Session, to read: 18 626.171 Application for license as an agent, customer 19 representative, adjuster, service representative, or reinsurance 20 intermediary.— 21 (8)(a) Cellular telephone numbers collected by the 22 department under subsection (2) are exempt from s. 119.07(1) and 23 s. 24(a), Art. I of the State Constitution. This exemption 24 applies to cellular telephone numbers held by the department 25 HB 991 2024 CODING: Words stricken are deletions; words underlined are additions. hb0991-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S before, on, or after the effective date of this act. 26 (b) Secure login credentia ls held by the department for 27 the purpose of allowing a person to electronically file or 28 review records under this section are exempt from s. 119.07(1) 29 and s. 24(a), Art. I of the State Constitution. This exemption 30 applies to secure login credentials held by the department 31 before, on, or after the effective date of this act. As used in 32 this paragraph, the term "secure login credential" means 33 information held by the department for purposes of 34 authenticating a user's logging into a user account on a 35 computer, a computer system, a computer network, or an 36 electronic device; an online user account accessible via the 37 Internet, whether through a mobile device, a website, or any 38 other electronic means; or information used for authentication 39 or password recovery. 40 (c) This subsection is subject to the Open Government 41 Sunset Review Act in accordance with s. 119.15 and shall stand 42 repealed on October 2, 2029, unless reviewed and saved from 43 repeal through reenactment by the Legislature. 44 Section 2. The Legislature finds that it is a public 45 necessity that all cellular phone numbers and secure login 46 credentials held by the Department of Financial Services 47 relating to electronically filed applications for licenses as 48 insurance agents, customer representatives, adjusters, service 49 representatives, and reinsurance intermediaries be made exempt 50 HB 991 2024 CODING: Words stricken are deletions; words underlined are additions. hb0991-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S from s. 119.07(1), Florida Statutes, and s. 24(a), Article I of 51 the State Constitution. The unintentional publication of such 52 information may subject the filer to identity theft, finan cial 53 harm, or other adverse impacts. Without this public records 54 exemption, the effective and efficient administration of the 55 electronic filing system, which is otherwise designed to 56 increase the ease of filing records, would be hindered. For 57 these reasons, the Legislature finds that the public records 58 exemption for all cellular phone numbers and secure login 59 credentials held by the Department of Financial Services 60 relating to electronically filed applications for licenses as 61 insurance agents, customer repr esentatives, adjusters, service 62 representatives, and reinsurance intermediaries serves a public 63 purpose. 64 Section 3. The Division of Law Revision is directed to 65 replace the phrase "the effective date of this act" wherever it 66 occurs in this act with the date this act becomes a law. 67 Section 4. This act shall take effect on the same date 68 that HB 989 or similar legislation takes effect , if such 69 legislation is adopted in the same legislative session or an 70 extension thereof and becomes a law. 71
