or lascivious grooming; providing criminal penalties; 4

Be It Enacted by the Legislature of the State of Florida: 7

Section 1. Subsection (8) of section 800.04, Florida 9
Statutes, is renumbered as subsection (9), and a new subsection 10
(8) is added to that section, to read: 11
800.04 Lewd or lascivious offenses committed upon or in 12
the presence of persons less than 16 years of age. — 13
(8) LEWD OR LASCIVIOUS GROOMING. — 14
(a) A person who engages in the process of preparing or 15
encouraging a child to engage in sexual activity throug h overtly 16
sexually themed communication with the child or in conduct with 17
or observed by the child without permission from the child's 18
parent or legal guardian commits lewd or lascivious grooming. 19
(b) A person 18 years of age or older who commits lewd or 20
lascivious grooming commits a felony of the second degree, 21
punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 22
Section 2. This act shall take effect October 1, 2024. 23
