A bill to be entitled 1 
An act relating to coordinated systems of care for 2 
children; amending s. 397.96, F.S.; defining the term 3 
"care coordination"; providing requirements for care 4 
coordinators; conforming provisions to changes made by 5 
the act; creating s. 1006.05, F.S.; requiring certain 6 
school districts to adhere to a specified mental 7 
health and treatment support system for certain 8 
children, to address certain recommendations, and meet 9 
specified performance outcomes; requiring certain 10 
school districts to have a care coordinator provided 11 
by a managing entity placed in such districts for 12 
certain purposes; requiring each school district to 13 
report annually to the Department of Education on 14 
certain outcomes and funding; providing an effective 15 
date. 16

Be It Enacted by the Legislature of the State of Florida: 18 
 19 
 Section 1.  Section 397.96, Florida Statutes, is amended to 20 
read: 21 
 397.96  Care coordination Case management for complex 22 
substance abuse cases.— 23 
 (1)  Contingent upon specific appropriations, it is the 24 
intent of the Legislature to provide for a more intensive level 25

of care coordination case management for complex cases involving 26 
children who need substance abuse services. Such se rvices shall 27 
be directed toward children receiving services from several 28 
agencies or programs to address the complex problems created by 29 
substance abuse, dependency, or addiction. 30 
 (2)  The department shall determine when a child receiving 31 
children's substance abuse services under this part shall have a 32 
care coordinator case manager. 33 
 (3)  For the purposes of this section, "care coordination" 34 
has the same meaning as in s. 394.4573(1). "case management" 35 
means those activities aimed at: 36 
 (a)  Implementing a t reatment plan; 37 
 (b)  Advocacy; 38 
 (c)  Linking services providers to a child and family; 39 
 (d)  Monitoring services delivery; and 40 
 (e)  Collecting information to determine the effect of 41 
services and treatment. 42 
 (4)  The care coordinator case manager shall periodically 43 
review services utilization to ascertain compliance with plans 44 
approved by the planning team. 45 
 (5)  In the attempt to minimize duplication, it is the 46 
intent of the Legislature that a child have no more than one 47 
care coordinator case manager. 48 
 Section 2.  Section 1006.05, Florida Statutes, is created 49

 1006.05  Mental health coordinated system of care. — 51 
 (1)  Pursuant to s. 394.491 and to further promote the 52 
effective implementation of a coordinated system of care 53 
pursuant to ss. 394.4573 and 394.495, each school district that 54 
provides mental health assessment, diagnosis, intervention, 55 
treatment, and recovery services to students diagnosed with one 56 
or more mental health or any co -occurring substance use disorder 57 
and students at high risk o f such diagnoses shall be guided by 58 
and adhere to the guiding principles of the mental health 59 
treatment and support system as provided under s. 394.491. 60 
 (2)(a)  School districts shall contract with managing 61 
entities to provide care coordination as defined in s. 62 
394.4573(1) for students with complex behavioral health needs 63 
who continue to experience adverse outcomes due to unmet needs 64 
or an inability to engage. 65 
 (b)  A care coordinator provided by the managing entity 66 
shall be placed in each school district implementing a 67 
coordinated system of care under subsection (1) to ensure 68 
students are receiving necessary services and that appropriate 69 
funds are being used to support the cost of treatment, including 70 
Medicaid or other governmental or private health care o r health 71 
insurance programs, before accessing school -based mental health 72 
treatment and support system funding to purchase community -based 73 
services. 74 
 (c)  School districts shall address recommendations from 75

the care coordinator provided by the managing enti ty when a 76 
student is identified as having experienced an involuntary 77 
admission to an acute psychiatric care facility upon the return 78 
of the student to the school setting. 79 
 (3)(a)  Pursuant to s. 394.494, each school district shall 80 
meet the general performa nce outcomes for the child and 81 
adolescent mental health treatment and support system. 82 
 (b)  Each school district shall report annually to the 83 
department on the general performance outcomes for the child and 84 
adolescent mental health treatment and support sy stem and how 85 
the support system funding is allocated and spent. 86 
 Section 3.  This act shall take effect July 1, 2024. 87
