A bill to be entitled 1 
An act relating to potency for adult personal use of 2 
marijuana; creating s. 381.9861, F.S.; providing 3 
definitions; specifying the authorized potency of 4 
tetrahydrocannabinol when consuming marijuana for 5 
personal use; providing a contingent effective date. 6 
 7 
Be It Enacted by the Legislature of the State of Florida: 8 
 9 
 Section 1.  Section 381.9861, Florida Statutes, is created 10 
to read: 11 
 381.9861  Potency limits for adult personal use of 12 
marijuana.— 13 
 (1)  As used in this section, the term: 14 
 (a)  "Edibles" means commercially produced food items made 15 
with marijuana oil, but no other form of marijuana. 16 
 (b)  "Marijuana" means all parts of any plant of the gen us 17 
Cannabis, whether growing or not; the seeds thereof; the resin 18 
extracted from any part of the plant; and every compound, 19 
manufacture, salt, derivative, mixture, or preparation of the 20 
plant or its seeds or resin, including low -THC cannabis. 21 
 (c)  "Marijuana delivery device" means an object used, 22 
intended for use, or designed for use in preparing, storing, 23 
ingesting, inhaling, or otherwise introducing marijuana into the 24 
human body. 25

 (d)  "Personal use" means possession, purchase, or use of 26 
marijuana or a marijuana delivery device by an adult 21 years of 27 
age or older for nonmedical consumption. 28 
 (e)  "Potency" means the relative strength of cannabinoids, 29 
and the total amount, in milligrams, of tetrahydrocannabinol as 30 
the sum of delta-9-tetrahydrocannabinol, plus 0.877 multiplied 31 
by tetrahydrocannabinolic acid, plus delta -8-32 
tetrahydrocannabinol and cannabidiol as the sum of cannabidiol, 33 
plus 0.877 multiplied by cannabidiolic acid in the final 34 
product. 35 
 (2)  Marijuana for personal use may not have a 36 
tetrahydrocannabinol potency, by weight or volume, of greater 37 
than 30 percent for marijuana in a form for smoking or greater 38 
than 60 percent in the final product for all other forms of 39 
marijuana, excluding edibles. Edibles for personal use may not 40 
contain more than 200 milligrams of tetrahydrocannabinol and a 41 
single serving portion of an edible may not exceed 10 milligrams 42 
of tetrahydrocannabinol. 43 
 Section 2.  This act shall take effect 30 days after 44 
passage of an amendment to the State Constitution authorizing 45 
adult personal use of marijuana . 46
