A bill to be entitled 1 
An act relating to grounds for termination of parental 2 
rights; amending s. 39.806, F.S; prohibiting the 3 
Department of Children and Families and either party 4 
to a dissolution of marriage proceeding from filing a 5 
petition for termination of parental rights solely 6 
because the parent of a child is a qualified patient 7 
using medical marijuana; prohibiting a court from 8 
granting a petition for termination of parental righ ts 9 
solely because the parent of a child is a qualified 10 
patient using medical marijuana; providing an 11 
effective date. 12

Be It Enacted by the Legislature of the State of Florida: 14 
 15 
 Section 1.  Subsection (5) is added to section 39.806, 16 
Florida Statutes, to read: 17 
 39.806  Grounds for termination of parental rights. — 18 
 (5)(a)  A petition for termination of parental rights may 19 
not be filed by the department or either party in a dissolution 20 
of marriage proceeding based solely on the fact that the parent 21 
or parents of a child are qualified patients, as defined in s. 22 
381.986(1), and their use of medical marijuana is consistent 23 
with s. 381.986. 24 
 (b)  If a petition for termination of parental rights is 25

filed under subsection (1), a court may not grant the petition 26 
based solely on the fact that the parent or parents of a child 27 
are qualified patients, as defined in s. 381.986(1), and their 28 
use of medical marijuana is consistent with s. 381.986. 29 
 Section 2.  This act shall take effect July 1, 2024. 30
