A bill to be entitled 1 
An act relating to unlawful demolition of historical 2 
structures and landmarks; amending s. 162.09, F.S.; 3 
providing for enhanced fines for the unlawful 4 
demolition of certain historical structures and 5 
landmarks; providing that fines may not exceed a 6 
specified amount; providing an effective date. 7 
 8 
Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  Paragraph (e) is added to subsection (2) of 11 
section 162.09, Florida Statutes, to read: 12 
 162.09  Administrative fines; costs of repair; liens. — 13 
 (2) 14 
 (e)  The demolition of a structure individually listed on, 15 
or contributing to, the National Register of Historic Places or 16 
of an individually listed l ocal historic landmark may be the 17 
basis for an enhanced fine if the code enforcement board or 18 
special magistrate makes specific findings based on competent, 19 
substantial evidence that the demolition of the historic 20 
structure or landmark was not permitted an d was not the result 21 
of a natural disaster. Fines imposed by the code enforcement 22 
board or special magistrate may not to exceed an amount that is 23 
20 percent of the value of the property as identified in the 24 
property appraiser's evaluation of its fair marke t value. 25

 Section 2.  This act shall take effect July 1, 2024. 26
