An act relating to trust funds; creating s. 16.717, 2
F.S.; creating the Federal Law Enforcement Trust Fund 3
within the Florida Gaming Control Commission; 4
providing for sources of funds and purpose; 5
authorizing any unexpended balance at a specified time 6
to remain in such trust fund for certain purpose; 7
providing for future review and termination or re -8
creation of the trust fund; providing an effective 9

Be It Enacted by the Legislature of the State of Florida: 12

Section 1. Section 16.717, Florida Statutes, is created to 14
read: 15
16.717 Federal Law Enforcement Trust Fund. — 16
(1) The Federal Law Enforcement Trust Fund is created 17
within the Florida Ga ming Control Commission. The commission may 18
deposit into the trust fund receipts and revenues received as a 19
result of federal criminal, administrative, or civil forfeiture 20
proceedings and receipts and revenues received from federal 21
asset-sharing programs. Deposited funds may be used for the 22
operation of the Florida Gaming Control Commission in accordance 23
with ss. 16.71-16.716. The trust fund is exempt from the service 24
charges imposed by s. 215.20. 25

(2) Notwithstanding the provisions of s. 216.301 and 26
pursuant to s. 216.351, any balance in the trust fund at the end 27
of any fiscal year shall remain in the trust fund at the end of 28
the year and shall be available for carrying out the purposes of 29
the trust fund. 30
(3) In accordance with s. 19(f)(2), Art. III of t he State 31
Constitution, the Federal Law Enforcement Trust Fund shall, 32
unless terminated sooner, be terminated on July 1, 2028. Before 33
its scheduled termination, the trust fund shall be reviewed as 34
provided in s. 215.3206(1) and (2). 35
Section 2. This act shall take effect July 1, 2024. 36
