HB 15A 2025A CODING: Words stricken are deletions; words underlined are additions. hb15a-00 Page 1 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to combatting illegal immigration; 2 amending s. 97.051, F.S.; revising the oath a person 3 subscribes to upon registering to vote; amending s. 4 104.011, F.S.; providing criminal penalties for 5 unauthorized aliens who willfully swear or affirm to 6 any oath or affirmation in connection with or arising 7 out of voting or elections and for persons who have 8 knowledge that such a registrant is an unauthoriz ed 9 alien; providing criminal penalties for unauthorized 10 aliens who willfully submit false voter registration 11 information and for persons who have knowledge that 12 such a registrant is an unauthorized alien; amending 13 s. 104.15, F.S.; providing criminal penalt ies for 14 unauthorized aliens who, knowing that they are not 15 qualified electors, willfully vote at any election and 16 for persons who aid or solicit another person who is 17 an unauthorized alien to such action; providing for 18 severability; providing effective dat es. 19 20 Be It Enacted by the Legislature of the State of Florida: 21 22 Section 1. Section 97.051, Florida Statutes, is amended to 23 read: 24 97.051 Oath upon registering. —A person registering to vote 25 HB 15A 2025A CODING: Words stricken are deletions; words underlined are additions. hb15a-00 Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S must subscribe to the following oath: "I do solemnly swear (or 26 affirm) that I will protect and defend the Constitution of the 27 United States and the Constitution of the State of Florida, that 28 I am qualified to register as an elector under the Constitution 29 and laws of the State of Florida, and that all information 30 provided in this application is true. I have carefully reviewed 31 the instructions for completing the Florida Voter Registration 32 Application, and I further swear (or affirm) that I am a United 33 States citizen, and I understand that if I have provided false 34 information on this application I could be subject to criminal 35 penalties for perjury and that I may be fined, imprisoned, or, 36 if not a United States citizen, deported from or refused entry 37 into the United States. " 38 Section 2. Effective March 31, 2025, sec tion 104.011, 39 Florida Statutes, is amended to read: 40 104.011 False swearing; submission of false voter 41 registration information; prosecution prohibited. — 42 (1)(a) A person who willfully swears or affirms falsely to 43 any oath or affirmation, or willfully pr ocures another person to 44 swear or affirm falsely to an oath or affirmation, in connection 45 with or arising out of voting or elections commits a felony of 46 the third degree, punishable as provided in s. 775.082, s. 47 775.083, or s. 775.084. 48 (b) A person who commits a violation of paragraph (a) and 49 who is an unauthorized alien as defined in s. 908.111, or who 50 HB 15A 2025A CODING: Words stricken are deletions; words underlined are additions. hb15a-00 Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S assists another in violation of paragraph (a) and has knowledge 51 that the registrant is an unauthorized alien as defined in s. 52 908.111, commits a felony of the second degree, punishable as 53 provided in s. 775.082, s. 775.083, or s. 775.084. 54 (2)(a) A person who willfully submits any false voter 55 registration information commits a felony of the third degree, 56 punishable as provided in s. 775.082 or s. 775.083. 57 (b) A person who commits a violation of paragraph (a) and 58 who is an unauthorized alien as defined in s. 908.111, or who 59 assists another in violation of paragraph (a) and has knowledge 60 that the registrant is an unauthorized alien as defined in s. 61 908.111, commits a felony of the second degree, punishable as 62 provided in s. 775.082, s. 775.083, or s. 775.084. 63 (3) A person may not be charged or convicted for a 64 violation of this section for affirming that he or she has not 65 been convicted of a felony or that, if convicted, he or she has 66 had voting rights restored, if such violation is alleged to have 67 occurred on or after January 8, 2019, but before July 1, 2019. 68 Section 3. Section 104.15, Florida Statutes, is amended to 69 read: 70 104.15 Unqualified electors willfully voting.— 71 (1) Whoever, knowing he or she is not a qualified elector, 72 willfully votes at any election is guilty of a felony of the 73 third degree, punishable as provided in s. 775.082, s. 775.083, 74 or s. 775.084. 75 HB 15A 2025A CODING: Words stricken are deletions; words underlined are additions. hb15a-00 Page 4 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (2) A person who commits a violation of subsection (1) and 76 who is an unauthorized alien as defined in s. 908.111, or a 77 person who aids or solicits another to violate subsection (1) 78 with knowledge that such person is an unauthorized alien as 79 defined in s. 908.111, commits a felony of the second degree, 80 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 81 Section 4. If any provision of this act or its 82 application to any person or circumstance is held invalid, the 83 invalidity does not affect other provisions or applicati ons of 84 this act which can be given effect without the invalid provision 85 or application, and to this end the provisions of this act are 86 severable. 87 Section 5. Except as otherwise expressly provided in this 88 act, this act shall take effect upon becoming a law. 89
