Subsections (4) and (5) of section 381.96, 12 Florida Statutes, are renumbered as subsections (5) and (6), 13 respectively, subsection (3) is amended, and a new subsection 14 (4) is added to that section, to read: 15 381.96 Pregnancy support and wellness services. — 16 (3) CONTRACT REQUIREMENTS. —The department contract must 17 shall specify the contract deliverables, including financial 18 reports and other reports due to the department, timeframes for 19 achieving contractual obligations, and any other requirements 20 the department determines are necessary, such as staffing and 21 location requirements. The contract must shall require the 22 network to: 23 (a) Establish, implement, and monitor a comprehensive 24 system of care through subcontractors to meet the pregnancy and 25 HB 63 2025 CODING: Words stricken are deletions; words underlined are additions. hb63-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S parenting support and wellness needs of eligible clients. 26 (b) Establish and manage subcontracts with a sufficient 27 number of providers to ensure the availability of pregnancy and 28 parenting support services and wellness services for eligible 29 clients, and maintain and mana ge the delivery of such services 30 throughout the contract period. 31 (c) Spend at least 85 percent of the contract funds on 32 pregnancy and parenting support services, excluding services 33 specified in subparagraph (1)(d)4., and wellness services. 34 (d) Offer wellness services through vouchers or other 35 appropriate arrangements that allow the purchase of services 36 from qualified health care providers. 37 (e) Require a background screening under s. 943.0542 for 38 all paid staff and volunteers of a subcontractor if such staff 39 or volunteers provide direct client services to an eligible 40 client who is a minor or an elderly person or who has a 41 disability. 42 (f) Annually monitor its subcontractors and specify the 43 sanctions that shall be imposed for noncompliance with the term s 44 of a subcontract. 45 (g) Subcontract only with providers that exclusively 46 promote and support childbirth. 47 (h) Ensure that informational materials provided to an 48 eligible client by a provider include only are current, 49 medically and accurate information and cite the reference source 50 HB 63 2025 CODING: Words stricken are deletions; words underlined are additions. hb63-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S of any medical statement included in such materials. The 51 contract must include fines as a penalty for noncompliance with 52 this paragraph. 53 (i) Ensure that organizations within the network make 54 information on local rape crisis c enters and sexual assault 55 treatment centers readily available to clients. 56 (j)(i) Ensure that the department is provided with all 57 information necessary for the report required under subsection 58 (6) (5). 59 (k) Perform an annual financial audit of each organization 60 within the network and submit a report of the audit to the 61 President of the Senate and the Speaker of the House of 62 Representatives by February 1 each year. 63 (4) DEPARTMENT VISITS. —The department shall visit each 64 organization within the networ k at least annually to determine 65 compliance with the terms of the contract. The visit must be an 66 unannounced visit conducted during the organization's regular 67 business hours. 68 Section 2. This act shall take effect July 1, 2025. 69
