A bill to be entitled 1 
An act relating to regulation of presidential 2 
libraries; creating s. 257.51, F.S.; providing 3 
legislative findings; preempting to the state all 4 
regulatory authority over the establishment, 5 
maintenance, activities, and operations of 6 
presidential libraries; deferring such regulatory 7 
authority to the Federal Government; defining the term 8 
"presidential library"; prohibiting counties, 9 
municipalities, or other pol itical subdivisions from 10 
enacting or enforcing any ordinance, resolution, rule, 11 
or other measure regarding presidential libraries 12 
unless authorized by federal law; providing an 13 
effective date. 14

Be It Enacted by the Legislature of the State of Florida : 16 
 17 
 Section 1.  Section 257.51, Florida Statutes, is created to 18 
read: 19 
 257.51  Preemption of regulation of presidential 20 
libraries.— 21 
 (1)  The Legislature finds that presidential libraries are 22 
unique national institutions designated to house, preserve, an d 23 
make accessible the records of former presidents. This section 24 
preempts to the state all regulation of the establishment, 25

maintenance, activities, and operations of any presidential 26 
library within its jurisdiction and defers regulation of such 27 
institutions to the Federal Government. 28 
 (2)  As used in this section, the term "presidential 29 
library" means an institution administered or designated under 30 
the Presidential Libraries Act, as amended, Pub. L. No. 99 -323, 31 
established for the preservation and accessib ility of 32 
presidential records and related historical materials. 33 
 (3)  A county, a municipality, or another political 34 
subdivision of this state may not enact or enforce any 35 
ordinance, resolution, rule, or other measure governing the 36 
establishment, maintenan ce, or operation of a presidential 37 
library or impose any requirement or restriction thereon, except 38 
as otherwise authorized by federal law. 39 
 Section 2. This act shall take effect upon becoming a law. 40
