Section 395.1013, Florida Statutes, is created 12 to read: 13 395.1013 Smoke evacuation systems required. — 14 (1) As used in this section, the term: 15 (a) "Smoke evacuation system" means equipment that 16 effectively captures, filters , and eliminates surgical smoke at 17 the site of origin before the smoke makes contact with the eyes 18 or respiratory tract of occupants in the room. 19 (b) "Surgical smoke" means the gaseous byproduct produced 20 by energy-generating devices such as lasers and el ectrosurgical 21 devices. The term includes, but is not limited to, surgical 22 plume, smoke plume, bio -aerosols, laser-generated airborne 23 contaminants, and lung -damaging dust. 24 (2) By January 1, 2026, each licensed facility shall adopt 25 HB 103 2025 CODING: Words stricken are deletions; words underlined are additions. hb103-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S and implement policies t hat require the use of a smoke 26 evacuation system during any surgical procedure that is likely 27 to generate surgical smoke. 28 Section 2. This act shall take effect July 1, 2025. 29
