A bill to be entitled 1 
An act relating to subsidy payments for the home care 2 
for the elderly program; amending s. 430.605, F.S.; 3 
requiring that subsidy payments made by the Department 4 
of Elder Affairs for the home care for the elderly 5 
program cease for certain persons upon such persons' 6 
enrollment in the Medicaid long -term care managed care 7 
program; providing applicability; providing a 8 
grandfather clause; amending s. 430.606, F.S.; 9 
conforming provisions to changes made by the act; 10 
providing an effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Section 430.605, Florida Statutes, is amended 15 
to read: 16 
 430.605  Subsidy payments. — 17 
 (1) The department shall develop a schedule of subsidy 18 
payments to be made to persons providing home care, and to 19 
providers of goods and services, for certain eligible elderly 20 
persons. Payments must be based on the financial status of the 21 
person receiving care. Payments m ust include, but need not be 22 
limited to: 23 
 (a)(1) A support and maintenance element, including costs 24 
of housing, food, clothing, and incidentals. 25

 (b)(2) Payments for medical, pharmaceutical, and dental 26 
services essential to maintain the health of the eld erly person 27 
and not covered by Medicare, Medicaid, or any form of insurance. 28 
 (c)(3) When necessary, special supplements to provide for 29 
any goods and services and specialized care required to maintain 30 
the health and well-being of the elderly person. Extra ordinary 31 
medical, dental, or pharmaceutical expenses may be paid as a 32 
special supplement. 33 
 (2)(a)  Subsidy payments made by the department under 34 
subsection (1) for an eligible elderly person must cease as soon 35 
as the eligible elderly person enrolls in the Medicaid long-term 36 
care managed care program under s. 409.979. 37 
 (b)  Paragraph (a): 38 
 1.  Applies to subsidy payments made for an eligible 39 
elderly person who is released from the wait list for the 40 
Medicaid long-term care managed care program for enrollment in 41 
such program under s. 409.979 on or after July 2, 2025. 42 
 2.  Does not affect in any way subsidy payments made for an 43 
eligible elderly person who, as of July 1, 2025: 44 
 a.  Receives services under the home care for the elderly 45 
program; and 46 
 b.  Is enrolled in the Medicaid long -term care managed care 47 
program under s. 409.979. 48 
 Section 2.  Section 430.606, Florida Statutes, is amended 49 
to read: 50

 430.606 Eligibility for services. —The criteria for 51 
determining eligibility for this program shall be substantially 52 
similar to the criteria used to determine eligibility for 53 
nursing home care under the Medicaid program. Subsidy payments 54 
made by the department to a person providing home care, and to a 55 
provider of goods and services, for an eligible elderly person 56 
must comply with the requirements of s. 430.605. 57 
 Section 3. This act shall take effect July 1, 2025. 58
