A bill to be entitled 1 
An act relating to dangerous excessive speeding; 2 
creating s. 316.1922, F.S.; providing conduct that 3 
constitutes dangerous excessive speeding; providing 4 
penalties; amending s. 318.14, F.S.; authorizing, 5 
rather than requiring, an officer to indicate the 6 
applicable civil penalty on certain traffic citations; 7 
amending s. 318.19, F.S.; requiring a person cited for 8 
certain driving infractions to appear at a sch eduled 9 
hearing; providing an effective date. 10 
 11 
Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Section 316.1922, Florida Statutes, is created 14 
to read: 15 
 316.1922  Dangerous excessive speeding. — 16 
 (1)  A person commits dangerous e xcessive speeding if he or 17 
she operates a motor vehicle: 18 
 (a)  In excess of the speed limit by 50 mph or more. 19 
 (b)  At 100 mph or more. 20 
 (2)  A person convicted of dangerous excessive speeding 21 
shall be punished: 22 
 (a)  Upon a first conviction, by imprisonm ent for up to 90 23 
days or by a fine of $500, or by both such fine and 24 
imprisonment. 25

 (b)  Upon a second or subsequent conviction, by 26 
imprisonment for up to 6 months or by a fine of $1,000, or by 27 
both such fine and imprisonment. A person convicted of a secon d 28 
or subsequent violation of this section that occurs within 5 29 
years after the date of a prior conviction for a violation of 30 
this section shall have his or her driving privilege revoked for 31 
at least 180 days but no more than 1 year. 32 
 Section 2.  Subsecti on (2) of section 318.14, Florida 33 
Statutes, is amended to read: 34 
 318.14  Noncriminal traffic infractions; exception; 35 
procedures.— 36 
 (2)  Except as provided in ss. 316.1001(2), 316.0083, 37 
316.173, and 316.1896, any person cited for a violation 38 
requiring a mandatory hearing listed in s. 318.19 or any other 39 
criminal traffic violation listed in chapter 316 must sign and 40 
accept a citation indicating a promise to appear. The officer 41 
may indicate on the traffic citation the time and location of 42 
the scheduled hearing . The officer and must indicate the 43 
applicable civil penalty established in s. 318.18 , except for 44 
infractions under s. 318.19(5) or s. 316.1926(2) . For all other 45 
infractions under this section, except for infractions under s. 46 
316.1001, the officer must cer tify by electronic, electronic 47 
facsimile, or written signature that the citation was delivered 48 
to the person cited. This certification is prima facie evidence 49 
that the person cited was served with the citation. 50

 Section 3.  Subsections (4) and (5) of sec tion 318.19, 51 
Florida Statutes, are amended, and subsection (6) is added to 52 
that section, to read: 53 
 318.19  Infractions requiring a mandatory hearing. —Any 54 
person cited for the infractions listed in this section shall 55 
not have the provisions of s. 318.14(2), (4), and (9) available 56 
to him or her but must appear before the designated official at 57 
the time and location of the scheduled hearing: 58 
 (4)  Any infraction of s. 316.520(1) or (2); or 59 
 (5)  Any infraction of s. 316. 183(2), s. 316.187, or s. 60 
316.189 of exceeding the speed limit by 30 mph or more ; or 61 
 (6)  Any infraction of s. 316.1926(2) . 62 
 Section 4. This act shall take effect July 1, 2025. 63
