A bill to be entitled 1 
An act relating to dangerous excessive speeding; 2 
creating s. 316.1922, F.S.; providing conduct that 3 
constitutes dangerous excessive speeding; providing 4 
penalties; amending s. 318.14, F.S.; authorizing, 5 
rather than requiring, an officer to indicate the 6 
applicable civil penalty on certain traffic citations; 7 
amending s. 318.19, F.S.; requiring a person cited for 8 
certain driving infractions to appear at a sch eduled 9 
hearing; providing an effective date. 10 
 11 
Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Section 316.1922, Florida Statutes, is created 14 
to read: 15 
 316.1922  Dangerous excessive speeding. — 16 
 (1)  A person commits dangerous e xcessive speeding if he or 17 
she operates a motor vehicle: 18 
 (a)  In excess of the speed limit by 50 mph or more. 19 
 (b)  At 100 mph or more in a manner that threatens the 20 
safety of other persons or property or interferes with the 21 
operation of any vehicle. 22 
 (2) A person convicted of dangerous excessive speeding 23 
shall be punished: 24 
 (a)  Upon a first conviction, by imprisonment for up to 30 25

days or by a fine of $500, or by both a fine and imprisonment. 26 
 (b)  Upon a second or subsequent conviction, by 27 
imprisonment for up to 90 days or by a fine of $1,000, or by 28 
both such fine and imprisonment. A person convicted of a second 29 
or subsequent violation of this section that occurs within 5 30 
years after the date of a prior conviction for a violation of 31 
this section shall h ave his or her driving privilege revoked for 32 
at least 180 days but no more than 1 year. 33 
 Section 2.  Subsection (2) of section 318.14, Florida 34 
Statutes, is amended to read: 35 
 318.14  Noncriminal traffic infractions; exception; 36 
procedures.— 37 
 (2)  Except as provided in ss. 316.1001(2), 316.0083, 38 
316.173, and 316.1896, any person cited for a violation 39 
requiring a mandatory hearing listed in s. 318.19 or any other 40 
criminal traffic violation listed in chapter 316 must sign and 41 
accept a citation indicating a pro mise to appear. The officer 42 
may indicate on the traffic citation the time and location of 43 
the scheduled hearing . The officer and must indicate the 44 
applicable civil penalty established in s. 318.18 , except for 45 
infractions under s. 318.19(5) or s. 316.1926(2 ). For all other 46 
infractions under this section, except for infractions under s. 47 
316.1001, the officer must certify by electronic, electronic 48 
facsimile, or written signature that the citation was delivered 49 
to the person cited. This certification is prima f acie evidence 50

that the person cited was served with the citation. 51 
 Section 3.  Subsections (4) and (5) of section 318.19, 52 
Florida Statutes, are amended, and subsection (6) is added to 53 
that section, to read: 54 
 318.19 Infractions requiring a mandatory hearing. —Any 55 
person cited for the infractions listed in this section shall 56 
not have the provisions of s. 318.14(2), (4), and (9) available 57 
to him or her but must appear before the designated official at 58 
the time and location of the scheduled hearing: 59 
 (4)  Any infraction of s. 316.520(1) or (2); or 60 
 (5)  Any infraction of s. 316.183(2), s. 316.187, or s. 61 
316.189 of exceeding the speed limit by 30 mph or more ; or 62 
 (6)  Any infraction of s. 316.1926(2) . 63 
 Section 4. This act shall take effect July 1, 2025. 64
