An act relating to rules for adult cardiovascular 2 
services; amending s. 395.1055, F.S.; revising 3 
criteria and procedures for establishing rules for 4 
adult cardiovascular services; providing an effective 5 
date. 6

Be It Enacted by the Legislature of the State of Florida: 8 
 9 
 Section 1.  Paragraphs (b) and (d) of subsection (18) and 10 
subsection (19) of section 395.1055, Florida Statutes, are 11 
amended to read: 12 
 395.1055  Rules and enforcement. — 13 
 (18)  In establishing rules for adult cardiovascular 14 
services, the agency shall include provisions that allow for: 15 
 (b)1.  For a hospital seeking a Level I program, the 16 
hospital must have demonstration that, for the most recent 12-17 
month period as reported to the agency, the hospital has 18 
provided a minimum of 300 adult inpatient and outpatient 19 
diagnostic cardiac catheterizations or, for the most recent 12 -20 
month period, has discharged or transferred at least 300 21 
patients with the principal diagnosis of ischemic heart disease 22 
and that it has a formalized, written transfer agreement with a 23 
hospital that has a Level II program, including written 24 
transport protocols to ensure safe and efficient transfer of a 25

patient within 60 min utes. 26 
 2.a.  A hospital located more than 100 road miles from the 27 
closest Level II adult cardiovascular services program is not 28 
required to meet the diagnostic cardiac catheterization volume 29 
and ischemic heart disease diagnosis volume requirements in 30 
subparagraph 1. if the hospital demonstrates that it has, for 31 
the most recent 12-month period as reported to the agency, 32 
provided a minimum of 100 adult inpatient and outpatient 33 
diagnostic cardiac catheterizations or that, for the most recent 34 
12-month period, it has discharged or transferred at least 300 35 
patients with the principal diagnosis of ischemic heart disease. 36 
 2.b. A hospital located more than 100 road miles from the 37 
closest Level II adult cardiovascular services program does not 38 
need to meet the 60-minute transfer time protocol requirement in 39 
subparagraph 1. if the hospital demonstrates that it has a 40 
formalized, written transfer agreement with a hospital that has 41 
a Level II program. The agreement must include written transport 42 
protocols to ensure the s afe and efficient transfer of a 43 
patient, taking into consideration the patient's clinical and 44 
physical characteristics, road and weather conditions, and 45 
viability of ground and air ambulance service to transfer the 46 
patient. 47 
 3.  At a minimum, the rules for adult cardiovascular 48 
services must require nursing and technical staff to have 49 
demonstrated experience in handling acutely ill patients 50

requiring intervention, based on the staff member's previous 51 
experience in dedicated cardiac interventional laboratorie s or 52 
surgical centers. If a staff member's previous experience is in 53 
a dedicated cardiac interventional laboratory at a hospital that 54 
does not have an approved adult open heart surgery program, the 55 
staff member's previous experience qualifies only if, at t he 56 
time the staff member acquired his or her experience, the 57 
dedicated cardiac interventional laboratory: 58 
 a.  Had an annual volume of 500 or more percutaneous 59 
cardiac intervention procedures. 60 
 b.  Achieved a demonstrated success rate of 95 percent or 61 
greater for percutaneous cardiac intervention procedures. 62 
 c.  Experienced a complication rate of less than 5 percent 63 
for percutaneous cardiac intervention procedures. 64 
 d.  Performed diverse cardiac procedures, including, but 65 
not limited to, balloon angioplast y and stenting, rotational 66 
atherectomy, cutting balloon atheroma remodeling, and procedures 67 
relating to left ventricular support capability. 68 
 (d)  Compliance with the most recent guidelines of the 69 
American College of Cardiology , and the American Heart 70 
Association, the Heart Rhythm Society for hospitals providing 71 
electrophysiology services, and the Society for Cardiovascular 72 
Angiography and Interventions guidelines for staffing, physician 73 
training and experience, operating procedures, equipment, 74 
physical plant, and patient selection criteria , to ensure 75

patient quality and safety. 76 
 (19)  The agency may adopt rules to administer the 77 
requirements of part II of chapter 408 and shall update agency 78 
rules as new standards and guidelines are published . 79 
 Section 2. This act shall take effect October 1, 2025. 80
