felonies; amending s. 921.141, F.S.; providing an 3
additional aggravating factor for sentencing for 4
capital felonies if a victim was gathered with one or 5
more persons for a specified activity; providing an 6
effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9

Section 1. Paragraph (q) is added to subsection (6) of 11
section 921.141, Florida Statutes, to read: 12
921.141 Sentence of death or life imprisonment for capital 13
felonies; further proceedings to determine sentence. — 14
(6) AGGRAVATING FACTORS. —Aggravating factors shall be 15
limited to the following: 16
(q) The victim of the ca pital felony was gathered with one 17
or more persons for a school activity, religious activity, or 18
public government meeting. 19
Section 2. This act shall take effect October 1, 2025. 20
