A bill to be entitled 1 
An act relating to social media use by minors; 2 
amending s. 501.1736, F.S.; requiring social media 3 
platforms to permanently delete certain information 4 
under specified circumstances, allow parents or legal 5 
guardians of certain minor account holders to view 6 
specified information, disclose certain data to law 7 
enforcement officers under specified circumstances, 8 
and prohibit certain minor account holders from using 9 
or accessing certain messages; providing an effective 10 
date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Paragraph (b) of subsection (2), paragraph (b) 15 
of subsection (3), and paragraph (b) of subsection (4) of 16 
section 501.1736, Florida Statutes, are amended to read: 17 
 501.1736  Social media use for minors. — 18 
 (2) 19 
 (b)  A social media platform shall: 20 
 1.  Terminate any account held by an account holder younger 21 
than 14 years of age, including accounts that the social media 22 
platform treats or categorizes as belonging to an account holder 23 
who is likely younger than 14 years of age for purposes of 24 
targeting content or advertising, and provide 90 days for an 25

account holder to dispute such termination. Termination must be 26 
effective upon the expiration of the 90 days if the account 27 
holder fails to effectively dispute the termination. 28 
 2.  Allow an account holder younger than 14 years of age to 29 
request to terminate the account. Termination must be effective 30 
within 5 business days after such request. 31 
 3.  Allow the confirmed parent or guardian of an account 32 
holder younger than 14 years of age to request that the minor's 33 
account be terminated. Termination must be effective within 10 34 
business days after such request. 35 
 4.  Permanently delet e all personal information held by the 36 
social media platform relating to the terminated account within 37 
45 days after termination of the account , unless there are legal 38 
requirements to maintain such information. 39 
 5.  Allow the confirmed parent or legal guar dian of an 40 
account holder younger than 14 years of age to view a list of 41 
the account names with which the minor has exchanged messages. 42 
 6.  Upon receipt of a valid legal process, including, but 43 
not limited to, a court order, subpoena, or search warrant th at 44 
complies with 18 U.S.C. s. 2703 and applicable state law, 45 
disclose to a law enforcement officer any technically feasible 46 
and reasonably available data that is responsive to a criminal 47 
investigation related to an account held by a minor. 48 
 7.  Prohibit an account holder who is younger than 14 years 49 
of age from using or accessing messages that are designed to 50

disappear or self-destruct after a certain period of time or 51 
upon viewing, or messages that are ephemeral in nature. 52 
 (3) 53 
 (b)  A social media platfor m shall: 54 
 1.  Terminate any account held by an account holder who is 55 
14 or 15 years of age, including accounts that the social media 56 
platform treats or categorizes as belonging to an account holder 57 
who is likely 14 or 15 years of age for purposes of targeting 58 
content or advertising, if the account holder's parent or 59 
guardian has not provided consent for the minor to create or 60 
maintain the account. The social media platform shall provide 90 61 
days for an account holder to dispute such termination. 62 
Termination must be effective upon the expiration of the 90 days 63 
if the account holder fails to effectively dispute the 64 
termination. 65 
 2.  Allow an account holder who is 14 or 15 years of age to 66 
request to terminate the account. Termination must be effective 67 
within 5 business days after such request. 68 
 3.  Allow the confirmed parent or guardian of an account 69 
holder who is 14 or 15 years of age to request that the minor's 70

requirements to maintain such information. 76 
 5.  Allow the confir med parent or legal guardian of an 77 
account holder who is 14 or 15 years of age to view a list of 78 
the account names with which the minor has exchanged messages. 79 
 6.  Upon receipt of a valid legal process, including, but 80 
not limited to, a court order, subpoe na, or search warrant that 81 
complies with 18 U.S.C. s. 2703 and applicable state law, 82 
disclose to a law enforcement officer any technically feasible 83 
and reasonably available data that is responsive to a criminal 84 
investigation related to an account held by a minor. 85 
 7.  Prohibit an account holder who is 14 or 15 years of age 86 
from using or accessing messages that are designed to disappear 87 
or self-destruct after a certain period of time or upon viewing, 88 
or messages that are ephemeral in nature. 89 
 (4)  If a court enjoins the enforcement of subsection (3) 90 
or would otherwise enjoin enforcement of any other provision of 91 
this section due to subsection (3), then subsection (3) shall be 92 
severed, and the following shall come into effect: 93 
 (b)  A social media platform sha ll: 94 
 1.  Terminate any account held by an account holder who is 95 
14 or 15 years of age, including accounts that the social media 96 
platform treats or categorizes as belonging to an account holder 97 
who is likely 14 or 15 years of age for purposes of targeting 98 
content or advertising, and provide 90 days for an account 99

 Section 2. This act shall take effect January 1, 2026. 127
