requiring certain electors be given a 88 provisional ballot; amending s. 101.6921, F.S.; 89 revising the voter's certificate; amending s. 90 101.6923, F.S.; revising the instructions that a 91 supervisor of elections must enclose with certain 92 vote-by-mail ballots; amending s. 322.141, F.S.; 93 requiring certain licenses and identification cards to 94 denote certain individuals as noncitizens; providing 95 an effective date. 96 97 Be It Enacted by the Legislature of the State of Florida: 98 99 Section 1. Section 97.026, Florida Statutes, is amended to 100 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 5 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S read: 101 97.026 Forms to be available in alternative formats and 102 via the Internet.— 103 (1) It is the intent of the Legisla ture that all forms 104 required to be used in chapters 97 -106 shall be made available 105 upon request, in alternative formats. Such forms shall include 106 vote-by-mail ballots as alternative formats for such ballots 107 become available and the Division of Elections is able to 108 certify systems that provide them. Whenever possible, such 109 forms, with the exception of vote -by-mail ballots, shall be made 110 available by the Department of State via the Internet. Sections 111 that contain such forms include, but are not limited to, ss . 112 97.051, 97.052, 97.053, 97.057, 97.058, 97.0583, 97.071, 97.073, 113 97.1031, 98.075, 99.021, 100.361, 100.371, 101.045, 101.171, 114 101.20, 101.6103, 101.62, 101.64, 101.65, 101.657, 105.031, 115 106.023, and 106.087. 116 (2) Instructions on how to cancel voter regi stration must 117 be prominently displayed on any Internet website that instructs 118 voters on how to update their voter registration information. 119 Section 2. Paragraph (n) of subsection (2) and paragraph 120 (f) of subsection (3) of section 97.052, Florida Statut es, are 121 amended to read: 122 97.052 Uniform statewide voter registration application. — 123 (2) The uniform statewide voter registration application 124 must be designed to elicit the following information from the 125 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 6 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S applicant: 126 (n) Florida driver license number or the identification 127 number from a Florida identification card issued under s. 128 322.051, and the last four digits of the applicant's social 129 security number. 130 (3) The uniform statewide voter registration application 131 must also contain: 132 (f) A statement inform ing an applicant who has not been 133 issued a Florida driver license, a Florida identification card, 134 or a social security number that if the application is submitted 135 by mail and the applicant is registering for the first time in 136 this state, the applicant will be required to provide 137 identification before prior to voting the first time. 138 Section 3. Subsection (6) of section 97.053, Florida 139 Statutes, is amended to read: 140 97.053 Acceptance of voter registration applications. — 141 (6)(a) A voter registration application, including an 142 application with a change in name, address, or party 143 affiliation, may be accepted as valid only after the department 144 has verified the authenticity or nonexistence of the driver 145 license number, the Florida id entification card number, or the 146 last four digits of the social security number provided by the 147 applicant. 148 1. If the voter registration applicant applies using a 149 driver license number or Florida identification card number, the 150 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 7 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S department and the supervis or of elections must also verify that 151 the driver license number or Florida identification card number 152 was not obtained using non -United States citizen documentation 153 and is classified as that of a United States citizen in 154 Department of Highway Safety and Mo tor Vehicles records. If the 155 driver license was obtained using non -United States citizen 156 documentation, every possible means must be used to determine if 157 the applicant became a naturalized citizen after obtaining his 158 or her driver license. The department m ay not accept as valid a 159 voter registration application if non -United States citizen 160 status is indicated and shall document the result of checks 161 completed to confirm that none of the supplied credentials 162 indicate non-United States citizen status. 163 2. If the voter registration applicant applies using the 164 last four digits of his or her social security number, the 165 department must use all possible means to verify citizenship 166 status and the applicant is required to present his or her 167 social security card before voting for the first time in this 168 state. A voter who presents at the polling place a social 169 security card that contains a work restriction must vote on a 170 provisional ballot and provide proof of citizenship before his 171 or her vote may be counted. 172 3. If the voter registration applicant applies without a 173 driver license number, Florida identification card number, or 174 social security number, all possible means must be used to 175 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 8 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S verify citizenship status, including data from the courts, 176 Department of Corrections, Department of Children and Families, 177 or any other governmental agency that collects citizenship data. 178 If there are no findings that indicate that the applicant is not 179 a United States citizen, the application may be accepted as 180 valid. 181 4. The voter's eligi bility to vote pursuant to s. 97.041 182 must be verified by comparing information from all available 183 sources, including the department's records, to determine if his 184 or her driver license is currently classified by the department 185 as a non-United States citize n license, a surrendered license of 186 a person who moved out of state, or a license of a person who is 187 deceased. 188 5. If a supervisor of elections determines that false 189 affirmations have been knowingly made on a voter registration 190 application, the matter mus t be referred to the Office of 191 Election Crimes and Security. 192 (b) If a completed voter registration application has been 193 received by the book -closing deadline but the driver license 194 number, the Florida identification card number, or the last four 195 digits of the social security number provided by the applicant 196 cannot be verified, the applicant shall be notified that the 197 number cannot be verified and that the applicant must provide 198 evidence to the supervisor sufficient to verify the authenticity 199 of the applicant's driver license number, Florida identification 200 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 9 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S card number, or last four digits of the social security number. 201 If the applicant provides the necessary evidence, the supervisor 202 shall place the applicant's name on the registration rolls as an 203 active voter. If the applicant has not provided the necessary 204 evidence or the number has not otherwise been verified prior to 205 the applicant presenting himself or herself to vote, the 206 applicant shall be provided a provisional ballot. The 207 provisional ballot shall be c ounted only if the number is 208 verified by the end of the canvassing period or if the applicant 209 presents evidence to the supervisor of elections sufficient to 210 verify the authenticity of the applicant's driver license 211 number, Florida identification card numbe r, or last four digits 212 of the social security number no later than 5 p.m. of the second 213 day following the election. 214 Section 4. Section 97.0535, Florida Statutes, is amended 215 to read: 216 97.0535 Special requirements for certain applicants. — 217 (1) Each applicant who registers by any method other than 218 at an office of the Department of Highway Safety and Motor 219 Vehicles mail and who has never previously voted in the state 220 and who the department has verified has not been issued a 221 current and valid Florida drive r license or, Florida 222 identification card, or social security number shall be required 223 to provide a copy of a current and valid identification, as 224 provided in subsection (3), or indicate that he or she is exempt 225 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 10 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S from the requirements before prior to voting. Such 226 identification or indication may be provided at the time of 227 registering, or at any time before prior to voting for the first 228 time in the state. If the voter registration application clearly 229 provides information from which a voter registration offici al 230 can determine that the applicant meets at least one of the 231 exemptions in subsection (4), the voter registration official 232 shall make the notation on the registration records of the 233 statewide voter registration system and the applicant shall not 234 be required to provide the identification required by this 235 section. 236 (2) The voter registration official shall, upon accepting 237 the voter registration application submitted pursuant to 238 subsection (1), determine if the applicant provided the required 239 identification at the time of registering. If the required 240 identification was not provided, the supervisor shall notify the 241 applicant that he or she must provide one of the following forms 242 of identification before prior to voting the first time in the 243 state. 244 (3)(a) The following forms of identification shall be 245 considered current and valid if they contain the name and 246 photograph of the applicant and have not expired: 247 1. United States passport. 248 2. United States naturalization papers, accompanied by an 252 acceptable identification that contains the name and photograph 253 of the applicant. 254 4. A consular report of birth abroad provided by the 255 United States Department of State, accompanied by an acceptable 256 identification that contains the name and photograph of the 257 applicant. 258 5. A social security card that does not contain a work 259 restriction, accompanied by an acceptable identification tha t 260 contains the name and photograph of the applicant. 261 (b) Acceptable identification for purposes of 262 subparagraphs (a)1.-5. include the following: 263 1.2. Debit or credit card. 264 2.3. Military identification. 265 3.4. Student identification. 266 4.5. Retirement center identification. 267 6. Neighborhood association identification. 268 5.7. Public assistance identification. 269 6.8. Veteran health identification card issued by the 270 United States Department of Veterans Affairs. 271 7.9. A license to carry a concealed weapo n or firearm 272 issued pursuant to s. 790.06. 273 8.10. Employee identification card issued by any branch, 274 department, agency, or entity of the Federal Government, the 275 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 12 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S state, a county, or a municipality. 276 (c)(b) The following forms of identification shall be 277 considered proof of residential address current and valid if 278 they are dated within the last 2 months and contain the name and 279 current residence address of the applicant as provided in the 280 voter registration application : 281 1. Utility bill. 282 2. Bank statement. 283 3. Government check. 284 4. Paycheck. 285 5. Other government document (excluding voter 286 identification card). 287 (4) The following persons are exempt from the 288 identification requirements of this section: 289 (a) Persons 65 years of age or older. 290 (a)(b) Persons with a temporary or permanent physical 291 disability, as documented by a doctor's note provided to a voter 292 registration official . 293 (b)(c) Members of the uniformed service on active duty , as 294 documented by a current military identification provide d to a 295 voter registration official, who, by reason of such active duty, 296 are absent from the county on election day. 297 (c)(d) Members of the Merchant Marine , as documented by a 298 current Merchant Marine identification provided to a voter 299 registration official , who, by reason of service in the Merchant 300 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 13 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Marine, are absent from the county on election day. 301 (d)(e) The spouse or dependent of a member referred to in 302 paragraph (b) (c) or paragraph (c), as documented by a uniformed 303 services dependent identification, (d) who, by reason of the 304 active duty or service of the member, is absent from the county 305 on election day. 306 (5)(f) A person Persons currently residing outside the 307 United States who is are eligible to vote in Florida and who is 308 not exempt from the identifi cation requirements of this section 309 under subsection (4) must meet the requirements of subsection 310 (3) except that he or she may provide one of the following in 311 lieu of a document listed in paragraph (3)(c): 312 (a) A document listed in paragraph (3)(c) which is not 313 current and an equivalent document providing his or her 314 residential address outside the United States. 315 (b) A consular report of birth abroad provided by the 316 United States Department of State and proof that his or her 317 parents previously resided in this state. 318 (6) Identification required under this section may be 319 submitted in the same manner as provided in s. 101.68(4)(d) . 320 Section 5. Present subsections (3) through (5) and (6) 321 through (14) of section 97.057, Florida Statutes, are 322 redesignated as subsections (4) through (6) and (8) through 323 (16), respectively, subsections (1) and (2) and present 324 subsections (5) and (10) are a mended, and new subsections (3), 325 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 14 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (7), (17), and (18) are added to that section, to read: 326 97.057 Voter registration by the Department of Highway 327 Safety and Motor Vehicles. — 328 (1) The Department of Highway Safety and Motor Vehicles 329 shall provide the opport unity to register to vote or to update a 330 voter registration record to each individual classified in 331 Department of Highway Safety and Motor Vehicles records as a 332 United States citizen who comes to an office of the Department 333 of Highway Safety and Motor Vehi cles that department to: 334 (a) Apply for or renew a driver license; 335 (b) Apply for or renew an identification card pursuant to 336 chapter 322; or 337 (c) Change an address on an existing driver license or 338 identification card. 339 (2) The Department of Highway Sa fety and Motor Vehicles 340 shall: 341 (a) Notify each individual who is classified in Department 342 of Highway Safety and Motor Vehicles records as a United States 343 citizen, orally or in writing, that: 344 1. Information gathered for the completion of a driver 345 license or identification card application, renewal, or change 346 of address can be automatically transferred to a voter 347 registration application; 348 2. If additional information and a signature are provided, 349 the voter registration application will be completed and sent to 350 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 15 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S the proper election authority; 351 3. Information provided can also be used to update a voter 352 registration record, except that party affiliation will not be 353 changed unless the individual designates a change in party 354 affiliation and separately consent s to such change in writing; 355 4. All declinations will remain confidential and may be 356 used only for voter registration purposes; and 357 5. The particular driver license office in which the 358 person applies to register to vote or updates a voter 359 registration record will remain confidential and may be used 360 only for voter registration purposes. 361 (b) Require a driver license examiner to inquire orally 362 or, if the applicant is hearing impaired, inquire in writing 363 whether the applicant wishes to register to vote or update a 364 voter registration record during the completion of a driver 365 license or identification card application, renewal, or change 366 of address. 367 1. If the applicant chooses to register to vote or to 368 update a voter registration record: 369 a. All applicable information received by the Department 370 of Highway Safety and Motor Vehicles in the course of filling 371 out the forms necessary under subsection (1) must be transferred 372 to a voter registration application. 373 b. The additional necessary information must be ob tained 374 by the driver license examiner and must not duplicate any 375 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 16 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S information already obtained while completing the forms required 376 under subsection (1). 377 c. A voter registration application with all of the 378 applicant's voter registration information require d to establish 379 the applicant's eligibility pursuant to s. 97.041 must be 380 presented to the applicant to review and verify the voter 381 registration information received and to provide a wet signature 382 and an electronic signature affirming the accuracy of the 383 information provided. 384 d. The voter registration application may not be used to 385 change the party affiliation of the applicant unless the 386 applicant designates a change in party affiliation and provides 387 a separate signature consenting to the party affiliation change. 388 e. After verifying the voter registration information and 389 providing his or her signatures electronic signature , the 390 applicant must be provided with a printed receipt that includes 391 such information and documents any change in party affiliation. 392 2. If the applicant declines to register to vote, update 393 the applicant's voter registration record, or change the 394 applicant's address by either orally declining or by failing to 395 sign the voter registration application, the Department of 396 Highway Safety and Motor Vehicles must note such declination on 397 its records and shall forward the declination to the statewide 398 voter registration system. 399 (3) The Department of Highway Safety and Motor Vehicles 400 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 17 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S shall offer an individual identified as not being a United 401 States citizen the opportunity to update his or her driver 402 license classification upon becoming a United States citizen. 403 Upon updating his or her driver license classification to 404 reflect United States citizenship, the individual must be 405 offered the opportunit y to register to vote. 406 (6)(5) The Department of Highway Safety and Motor Vehicles 407 must send, with each driver license renewal extension 408 application authorized pursuant to s. 322.18(8) and sent to an 409 individual classified in Department of Highway Safety a nd Motor 410 Vehicles records as a United States citizen , a uniform statewide 411 voter registration application, the voter registration 412 application prescribed under paragraph (4)(a) (3)(a), or a voter 413 registration application developed especially for the purposes 414 of this subsection by the Department of Highway Safety and Motor 415 Vehicles, with the approval of the Department of State, which 416 must meet the requirements of s. 97.052. 417 (7) The Department of Highway Safety and Motor Vehicles 418 must send, with each driver l icense renewal extension 419 application authorized pursuant to s. 322.18(8) and sent to an 420 individual classified in the Department of Highway Safety and 421 Motor Vehicles records as a non -United States citizen, 422 instructions on how he or she may update his or her driver 423 license classification upon becoming a United States citizen. 424 (12)(10) The department shall provide the Department of 425 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 18 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Highway Safety and Motor Vehicles with an electronic database of 426 street addresses valid for use as the address of legal residenc e 427 as required in s. 97.053(5). The Department of Highway Safety 428 and Motor Vehicles shall compare the address provided by the 429 applicant against the database of valid street addresses. If the 430 address provided by the applicant does not match a valid street 431 address in the database, the applicant will be asked to verify 432 the address provided. The Department of Highway Safety and Motor 433 Vehicles shall not reject any application for voter registration 434 for which a valid match cannot be made , however, the voter shall 435 be informed that he or she may be required to vote in person 436 until the address is corrected . 437 (17)(a) The Department of Highway Safety and Motor 438 Vehicles must notify the Department of State when a driver 439 license has been made invalid due to the issuance o f a driver 440 license in another state or due to notification of death. The 441 Department of State must report each such change to the 442 appropriate supervisor of elections, who shall remove the 443 registered voter from the statewide voter registration system in 444 accordance with s. 98.075(3)(a) or (7), as applicable. 445 (b) The Department of Highway Safety and Motor Vehicles 446 shall make driver license surrender and death reports available 447 in weekly reports to the Department of State and make driver 448 license surrender and death status available by means of online 449 or written query and customized reports to the Department of 450 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 19 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S State and supervisors of elections. 451 (18)(a) The Department of Highway Safety and Motor 452 Vehicles must notify the Department of State when a Florida 453 identification card or driver license has been obtained with 454 documentation that indicates that the applicant is not a United 455 States citizen. Documentation deemed to indicate that an 456 individual is not a United States citizen includes social 457 security cards that contain a work restriction, alien 458 registration receipt cards, employment authorization cards 459 issued by the United States Department of Homeland Security, and 460 proof of nonimmigrant classification provided by the United 461 States Department of Homeland Security . 462 (b) The Department of Highway Safety and Motor Vehicles 463 shall furnish information identifying those persons who, during 464 the preceding week, presented evidence of non -United States 465 citizenship under this subsection as part of the weekly report 466 required under s. 98.093(8). The information must also be 467 available upon written or electronic request by the Department 468 of State or a supervisor of elections. Information provided 469 under this subsection must be considered under s. 98.075(6). 470 Section 6. Paragrap h (g) is added to subsection (1) of 471 section 97.0575, Florida Statutes, to read: 472 97.0575 Third-party voter registration organizations. — 473 (1) Before engaging in any voter registration activities, 474 a third-party voter registration organization must register and 475 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 20 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S provide to the division, in an electronic format, the following 476 information: 477 (g) An affirmation that each person collecting voter 478 registration applications on behalf of the third -party voter 479 registration organization: 480 1. May not knowingly solicit persons who are not United 481 States citizens to register to vote; 482 2. Shall incorporate citizenship status and other 483 eligibility requirements listed in s. 97.041 in screening 484 questions; and 485 3. Shall provide any individual who indicates that he or 486 she is not a United States citizen or who displays a driver 487 license indicating that he or she is not a United States citizen 488 with instructions on how to register to vote upon becoming a 489 United States citizen. 490 Section 7. Subsection (1) and paragraph (a) of subs ection 491 (2) of section 97.058, Florida Statutes, are amended to read: 492 97.058 Voter registration agencies. — 493 (1) Each voter registration agency must provide each 494 applicant the opportunity to register to vote or to update a 495 voter registration record, at th e time the applicant applies for 496 services or assistance from that agency, for renewal of such 497 services or assistance, or for a change of address required with 498 respect to the services or assistance. For purposes of this 499 subsection, applicant only includes a person who affirms that 500 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 21 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S they are a citizen of the United States on the form provided 501 under subsection (2). 502 (2) Each voter registration agency, other than a public 503 library, must develop and provide each applicant with a form 504 approved by the department co ntaining all of the following: 505 (a) The questions: 506 1. "Are you a United States citizen?" If yes, continue. 507 2.1. "If you are not registered to vote where you live 508 now, would you like to apply to register to vote today?" 509 3.2. "If you are registered to vote where you live now, 510 would you like to update your voter registration record?" 511 Section 8. Paragraphs (b) and (c) of subsection (1) of 512 section 97.0585, Florida Statutes, are amended to read: 513 97.0585 Public records exemption; information regarding 514 voters and voter registration; confidentiality. — 515 (1) The following information held by an agency, as 516 defined in s. 119.011, and obtained for the purpose of voter 517 registration is confidential and exempt from s. 119.07(1) and s. 518 24(a), Art. I of the State Constitution and may be used only for 519 purposes of voter registration: 520 (b) Information relating to the place where a person 521 registered to vote or where a person updated a voter 522 registration, except for information relating to the method of 523 registration. 524 (c) The social security number, driver license number, and 525 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 22 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Florida identification number of a voter registration applicant 526 or voter, except for information relating to the type of number 527 provided. 528 Section 9. Paragraph (a) of subsection (1) of section 529 97.1031, Florida Statutes, is amended to read: 530 97.1031 Notice of change of residence, change of name, or 531 change of party affiliation. — 532 (1)(a) When an elector changes his or her residence 533 address, the elector must notify the supervisor of elections and 534 the supervisor shall verify the elector's eligibility status 535 using all available data sources . Except as provided in 536 paragraph (b), an address change must be submitted using a voter 537 registration application. 538 Section 10. Subsection (1) and paragraph (a) of subsection 539 (4) of section 98.045, Florida Statutes, are amended, and 540 paragraph (c) is added to subsection (2) of that section, to 541 read: 542 98.045 Administration of voter registration. — 543 (1) ELIGIBILITY OF APPLICANT. —The supervisor must ensure 544 that any eligible applicant for voter registration is registered 545 to vote and that each application for voter registration is 546 processed in accordance with law. The supervisor shall , using 547 all available data sources, determine whether a voter 548 registration applican t is ineligible based on any of the 549 following: 550 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 23 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (a) The failure to complete a voter registration 551 application as specified in s. 97.053. 552 (b) The applicant is deceased. 553 (c) The applicant has been convicted of a felony for which 554 his or her voting rights have not been restored. 555 (d) The applicant has been adjudicated mentally 556 incapacitated with respect to the right to vote and such right 557 has not been restored. 558 (e) The applicant does not meet the age requirement 559 pursuant to s. 97.041. 560 (f) The applicant is not a United States citizen. 561 (g) The applicant is a fictitious person. 562 (h) The applicant has provided an address of legal 563 residence that is not his or her legal residence. 564 (i) The applicant has provided a driver license number, 565 Florida identification card number, or the last four digits of a 566 social security number that is not verifiable by the department. 567 (2) REMOVAL OF REGISTERED VOTERS. — 568 (c) Information received from the Department of Highway 569 Safety and Motor Vehicles indicating that a regis tered voter in 570 the state has obtained a driver license in another state shall 571 be considered a written request from the voter to have the 572 voter's name removed from the statewide voter registration 573 system. 574 (4) STATEWIDE ELECTRONIC DATABASE OF VALID RESIDEN TIAL 575 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 24 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S STREET ADDRESSES.— 576 (a) The department shall compile and maintain a statewide 577 electronic database of valid residential street addresses from 578 the information provided by the supervisors of elections 579 pursuant to s. 98.015. The department shall evaluate the 580 information provided by the supervisors of elections to identify 581 any duplicate addresses and any address that may overlap county 582 boundaries. The department shall include in the database the 583 maximum number of occupants in accordance with the applicable 584 zoning regulations at each address. The department and 585 supervisors of elections shall use all available data sources 586 and methods to update mailing and registration addresses to be 587 accurate and CASS-compliant residential addresses. The 588 department shall ado pt rules that specify such sources and 589 methods. 590 Section 11. Present subsection (7) of section 98.065, 591 Florida Statutes, is redesignated as subsection (9), and a new 592 subsection (7) and subsection (8) are added to that section, to 593 read: 594 98.065 Registration list maintenance programs. — 595 (7) The supervisor of elections shall at least quarterly 596 conduct bulk list maintenance by comparing the county voter roll 597 to customized reports from the Department of Highway Safety, 598 Department of Children and Families, a nd Motor Vehicles and 599 other sources that may identify persons who are not United 600 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 25 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S States citizens, persons who have moved out of state, persons 601 who are deceased, and persons who are otherwise ineligible. 602 (8) The supervisor of elections shall at least quar terly 603 analyze the voter registration database to determine addresses 604 with more registered voters than allowed by applicable zoning 605 regulations. If the number of registered voters exceeds the 606 number allowed by the applicable zoning regulations, all 607 available sources must be utilized to determine if any voters at 608 that addresses have moved or become ineligible. If a voter is 609 determined to have moved, the supervisor of elections must 610 adhere to the procedures provided in subsection (4). If a voter 611 is determined to be ineligible, the supervisor of elections must 612 adhere to the procedures for removal pursuant to s. 98.075(7). 613 Section 12. Paragraph (b) of subsection (3) and subsection 614 (6) of section 98.075, Florida Statutes, are amended to read: 615 98.075 Registration records maintenance activities; 616 ineligibility determinations. — 617 (3) DECEASED PERSONS. — 618 (b) The supervisor shall remove the name of a deceased 619 registered voter from the statewide voter registration system 620 within 7 days after receipt of a cop y of a death certificate 621 issued by a governmental agency authorized to issue death 622 certificates or verified with information from Department of 623 Highway Safety and Motor Vehicles records that the registered 624 voter is deceased. 625 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 26 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (6) OTHER BASES FOR INELIGIBI LITY.—Subsections (2)-(5) do 626 not limit or restrict the department or the supervisor in his or 627 her duty to act upon direct receipt of, access to, or knowledge 628 of information from any credible source governmental entity that 629 identifies a registered voter as potentially ineligible. If the 630 department or supervisor receives information from any credible 631 source governmental entity other than those identified in 632 subsections (2)-(5) that a registered voter is ineligible 633 because the voter is deceased, adjudicated a convicted felon 634 without having had his or her voting rights restored, 635 adjudicated mentally incapacitated without having had his or her 636 voting rights restored, does not meet the age requirement 637 pursuant to s. 97.041, is not a United States citizen, is a 638 fictitious person, has surrendered his or her driver license to 639 another state, or has listed an address that is not his or her 640 address of legal residence, the supervisor must adhere to the 641 procedures set forth in subsection (7) before the removal of the 642 name of a registered voter who is determined to be ineligible 643 from the statewide voter registration system. 644 (a) The following are deemed credible sources from which 645 the department or a supervisor may determine that an elector is 646 ineligible and subject to the procedures for removal set forth 647 in subsection (7) or has had a change of address and is subject 648 to the procedures required under s. 98.065(4): 649 1. An affidavit from a homeowner association manager, 654 verified with information from the Department of Highway Safety 655 and Motor Vehicles records, county tax reco rds, or other 656 credible sources. 657 3. An affidavit from a county resident, verified with 658 information from the Department of Highway Safety and Motor 659 Vehicles records, county tax records, or other credible sources. 660 4. Social security death index licensees, provided that 661 the social security number matches the registered voter's social 662 security number and the information is verified by the 663 department or Department of Highway Safety and Motor Vehicles 664 personnel with direct access to the social security death i ndex 665 file. 666 (b) If the information from such an affidavit or licensee 667 cannot be verified using a second credible source, the 668 supervisor must send an address confirmation to the registered 669 voter. If the registered voter does not respond to the address 670 confirmation within 30 days, the supervisor must send an address 671 confirmation final notice to the registered voter. 672 Section 13. Subsection (1) of section 98.093, Florida 673 Statutes, is amended to read: 674 98.093 Duty of officials to furnish information relati ng 675 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 28 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S to deceased persons, persons adjudicated mentally incapacitated, 676 persons convicted of a felony, and persons who are not United 677 States citizens.— 678 (1) DUTIES.—In order to identify ineligible registered 679 voters and maintain accurate and current voter regi stration 680 records in the statewide voter registration system pursuant to 681 procedures in s. 98.065 or s. 98.075, it is necessary for the 682 department and supervisors of elections to receive or access 683 certain information from state and federal officials and 684 entities in the format prescribed. To the maximum extent 685 feasible, state and local government agencies shall facilitate 686 provision of information and access to data to the department 687 and supervisors of elections , including, but not limited to, 688 databases and customized reports in a format that can be used by 689 election officials to compare with voter registration data to 690 identify registered voters who are ineligible due to that 691 contain reliable criminal records, and records of deceased 692 status, surrendered driver li censes, a change of address, or 693 citizenship status persons. State and local government agencies 694 that provide such data must do so without charge if the direct 695 cost incurred by those agencies is not significant. 696 Section 14. Subsections (1) and (2) of se ction 98.255, 697 Florida Statutes, are amended to read: 698 98.255 Voter education programs. — 699 (1) The Department of State shall adopt rules prescribing 700 HB 831 2025 CODING: Words stricken are deletions; words underlined are additions. hb831-00 Page 29 of 38 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S minimum standards for nonpartisan voter education. The standards 701 shall, at a minimum, address all of the following: 702 (a) Voter registration .; 703 (b) Balloting procedures, by mail and polling place .; 704 (c) Voter rights and responsibilities .; 705 (d) Distribution of sample ballots .; and 706 (e) The importance of and method for updating a voter's 707 voter registration in formation and mailing address. 708 (f) The importance of and method for canceling a voter 709 registration upon moving out of state. 710 (g)(e) Public service announcements. 711 (2) Each county supervisor shall implement the minimum 712 voter education standards, and shall conduct additional 713 nonpartisan education efforts as necessary to ensure that voters 714 have a working knowledge of the voting process. A county 715 supervisor must provid e equal education on all methods of 716 voting. 717 Section 15. Subsection (2) of section 101.043, Florida 718 Statutes, is amended to read: 719 101.043 Identification required at polls. — 720 (2) If the elector fails to furnish the required 721 identification or if the identification provided denotes the 722 elector as a non-citizen as provided under s. 322.141(5) , the 723 elector shall be allowed to vote a provisional ballot. Subsection (3) of section 101.6921, Florida 727 Statutes, are amended to read: 728 101.6921 Delivery of special vote -by-mail ballot to 729 certain first-time voters.— 730 (3) The Voter's Certificate shall be in substantially the 731 following form: 732 Note: Please Read Instructions Carefully Before Marking Ballot 733 and Completing Voter's Certificate. 734 VOTER'S CERTIFICATE 735 I, ...., do solemnly swear or affirm that I am a qualified 736 and registered voter of .... County, Florida, and that I have 737 not and will not vote more than o ne ballot in this election. I 738 understand that if I commit or attempt to commit any fraud in 739 connection with voting, vote a fraudulent ballot, or vote more 740 than once in an election, I can be convicted of a felony of the 741 third degree and fined up to $5,000 a nd/or imprisoned for up to 742 5 years. I also understand that failure to sign this certificate 743 will invalidate my ballot. Subsection (2) of section 101.692 3, Florida 779 Statutes, is amended to read: 780 101.6923 Special vote -by-mail ballot instructions for 781 certain first-time voters.— 782 (2) A voter covered by this section must be provided with 783 printed instructions with his or her vote -by-mail ballot in 784 substantially the following form: 785 READ THESE INSTRUCTIONS CAREFULLY BEFORE MARKING YOUR BALLOT. 786 FAILURE TO FOLLOW THESE INSTRUCTIONS MAY CAUSE YOUR BALLOT NOT 787 TO COUNT. 788 1. In order to ensure that your vote -by-mail ballot will 789 be counted, it should be completed and returned as soon as 790 possible so that it can reach the supervisor of elections of the 791 county in which your precinct is located no later than 7 p.m. on 792 the date of the election. However, if you are an overseas voter 793 casting a ballot in a presidential prefere nce primary or general 794 election, your vote-by-mail ballot must be postmarked or dated 795 no later than the date of the election and received by the 796 supervisor of elections of the county in which you are 797 registered to vote no later than 10 days after the date of the 798 election. Unless you meet one of the exemptions in 7.b., you must 862 make a copy of one of the following forms of identification 863 which shows your name and current residence address as proof of 864 residential address: current utility bill, bank statement, 865 government check, paycheck, or government document (excluding 866 voter information card). 867 7.a. The identification requirements of Item 6.a. 6. do 868 not apply if you meet one of the following requirements : 869 a. You are 65 years of age or older. 870 (I)b. You are the spouse or dependent of a member 884 referred to in paragraph (II) c. or paragraph (III) d. who, by 885 reason of the active duty or service of the member, will be 886 absent from the county on election day. 887 (V)f. You are currently residing outside the United 888 States. 889 b. If you are currently residing outside of the United 890 States you must provide one of the follow ing: 891 (I) Any of the documents listed in 6.b. that are not 892 current, and a current document of the kind listing in 6.b. that 893 demonstrates that you reside outside of the United States. 894 (II) A Consular Report of Birth Abroad provided by the 895 United States Department of State and proof that your parents 896 previously resided in the state. 897 8. Place the envelope bearing the Voter's Certificate into 898 the mailing envelope addressed to the supervisor. Insert a copy 899 of your identification in the mailing envelope. Mail, deliver, or have delivered the completed mailing 904 envelope. Be sure there is suffici ent postage if mailed. 905 10. FELONY NOTICE. It is a felony under Florida law to 906 accept any gift, payment, or gratuity in exchange for your vote 907 for a candidate. It is also a felony under Florida law to vote 908 in an election using a false identity or false ad dress, or under 909 any other circumstances making your ballot false or fraudulent. 910 Section 18. Subsection (5) is added to section 322.141, 911 Florida Statutes, to read: 912 322.141 Color or markings of certain licenses or 913 identification cards. — 914 (5) All licenses for the operation of motor vehicles or 915 identification cards originally issued or reissued by the 916 department to persons who are not citizens of the United States 917 must have on the front of the license or identification card 918 "NC" to denote that such indiv idual is a noncitizen.
