Section 901.1501, Florida Statutes, is created 13 to read: 14 901.1501 Immediate arrest of a person with a significant 15 medical condition.— 16 (1) As used in this section, the term "person with a 17 significant medical condition" means a person who is a patient 18 or resident of a hospital licensed under chapter 395, a nurs ing 19 home facility licensed under part II of chapter 400, or an 20 assisted living facility licensed under part I of chapter 429. 21 (2) In determining whether to make an immediate arrest of 22 a person with a significant medical condition, including an 23 arrest for an offense committed against an elderly person or a 24 disabled adult, a law enforcement officer may use his or her 25 CS/HB 1099 2025 CODING: Words stricken are deletions; words underlined are additions. hb1099-01-c1 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S discretion based on the totality of the circumstances, including 26 consideration of whether the person is a current or continued 27 threat to public safety or himself or herself or a flight risk, 28 and may consider all available lawful methods of making an 29 arrest, including seeking an arrest warrant under s. 901.02. 30 (3) This section does not prohibit a law enforcement 31 officer from arresting a person without a warrant under s. 32 901.15, or making such an arrest by any lawful method. 33 Section 2. This act shall take effect July 1, 2025. 34
