A bill to be entitled 1 
An act relating to energy infrastructure investments; 2 
amending s. 366.075, F.S.; authorizing the Public 3 
Service Commission to establish an experimental 4 
mechanism that meets certain requirements to 5 
facilitate certain energy infrastructure investments 6 
in gas; providing requirements for gas infrastructure 7 
investments; authorizing the commission to make 8 
certain determinations regarding the experimental 9 
mechanism; defining the term "gas"; requiring the 10 
commission to adopt rules and propose such rules by a 11 
specified date; providing an effective date. 12

Be It Enacted by the Legislature of the State of Florida: 14 
 15 
 Section 1.  Subsection (3) is added to section 366.075, 16 
Florida Statutes, to read: 17 
 366.075 Experimental and transitional rates ; experimental 18 
mechanisms.— 19 
 (3)  The commission may establish an experimental mechanism 20 
to facilitate energy infrastructure investments in gas 21 
consistent with the structure set forth in s. 366.96(7) and (8) 22 
and the intent of s. 366.91(1). Such gas infrastructure 23 
investments may include only such investments that collect, 24 
prepare, clean, process, transport, or inject gas as a 25

transportation fuel or for pipeline distribution. The commiss ion 26 
shall have discretion to determine whether such mechanism is 27 
conducted in an annual proceeding. As used in this subsection, 28 
the term "gas" means anaerobically generated biogas, landfill 29 
gas, or wastewater treatment gas refined to a methane content of 30 
90 percent or greater which may be used as a transportation fuel 31 
or pipeline distribution. The commission shall adopt rules to 32 
implement and administer this subsection and shall propose such 33 
rules for adoption as soon as practicable but no later than 34 
January 1, 2026. 35 
 Section 2. This act shall take effect July 1, 2025. 36
