A bill to be entitled 1 
An act relating to energy infrastructure investment; 2 
amending s. 366.075, F.S.; requiring the Public 3 
Service Commission to establish an experimental 4 
mechanism that meets certain requirements to 5 
facilitate certain energy infrastructure investments 6 
in gas; providing requirements for gas infrastructure 7 
investments; defining the term "gas"; requiring the 8 
commission to adopt rules and propose such rules by a 9 
specified date; specifying matters that such rules 10 
must address; providing an effective date. 11 
 12 
Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Subsection (3) is added to section 366.075, 15 
Florida Statutes, to read: 16 
 366.075 Experimental and transitional rates ; experimental 17 
mechanisms.— 18 
 (3)(a)  The commission shall establish an experimental 19 
mechanism to facilitate energy infrastructure investments in gas 20 
consistent with the structure set forth in s. 366.99(2) –(6) and 21 
the intent of s. 366.91(1). Such gas infrastructure investments 22 
may include only such investments that collect, prepare, clean, 23 
process, transport, or inject gas as a transportation fuel or 24 
for pipeline distribution. As used in this subsection, the term 25

"gas" means anaerobic ally generated biogas, landfill gas, or 26 
wastewater treatment gas produced and collected in this state 27 
and refined to a methane content of 90 percent or greater which 28 
may be used as a transportation fuel or pipeline distribution. 29 
 (b)  The commission shall adopt rules to implement and 30 
administer this subsection and shall propose such rules for 31 
adoption as soon as practicable but no later than January 1, 32 
2026. Such rules shall provide for the allocation to public 33 
utility customers of the benefit of any tradea ble energy credits 34 
and tax savings associated with gas infrastructure investments 35 
made pursuant to this subsection and shall address the treatment 36 
of revenues from sales of gas from such investments for 37 
transportation purposes. 38 
 Section 2.  This act shall take effect July 1, 2025. 39
