A bill to be entitled 1 
An act relating to education on abusive head trauma; 2 
amending s. 411.2035, F.S.; requiring the Department 3 
of Health to adopt evidence -based parent education 4 
materials on the dangers of abusive head trauma, 5 
including shaken baby syndrome; specifying 6 
requirements for the parent education materials; 7 
specifying requirements for the distribution of the 8 
parent education materials; requiring the department 9 
to implement a multi-year phase-in plan for the 10 
distribution of the parent education materials; 11 
conforming provisions related to applicability, 12 
construction, and immunity from civil liability to 13 
changes made by the act; providing an effective date. 14

Be It Enacted by the Legislature of the State of Florida: 16 
 17 
 Section 1.  Section 411.2035, Florida Statutes, is amended 18 
to read: 19 
 411.2035  Dangers of abusive head trauma shaking infants 20 
and young children; requirements for distributing parent 21 
education materials brochures.— 22 
 (1)  Every hospital, birthing facility, and provider of 23 
home birth which has maternity and newborn services shall 24 
provide to the parents of a newborn, before they take their 25

newborn home from the hospital or birthing facility, written 26 
information with an explanation concerning the dangers of 27 
shaking infants and young children. 28 
 (1)(2) The Department of Health shall adopt evidence-based 29 
parent education materials prepare a brochure that describe 30 
describes the dangers of abusive head trauma, includ ing shaken 31 
baby syndrome shaking infants and young children . The parent 32 
education materials may be provided using written, visual, or 33 
electronic applications. The materials description must include, 34 
but need not be limited to, information concerning all of the 35 
following: 36 
 (a) The grave effects of shaking infants and young 37 
children., information concerning 38 
 (b) Appropriate ways to manage the causes that can lead a 39 
person to shake or harm infants and young children, including 40 
normal infant crying, fussing, and other causes. 41 
 (c) a discussion of Ways to reduce the risks that can lead 42 
a person to shake or harm infants and young children. 43 
 (d)  Evidence-based practices for safe infant sleep and the 44 
dangers associated with unsafe sleep environments for infants. 45 
 (e)  Information on the importance of carefully selecting a 46 
trusted and responsible caregiver, including warning signs of 47 
potential risk factors. 48 
 (2)(a)  The evidence -based parent education materials 49 
adopted by the Department of Health under subsection (1) must be 50

distributed as follows: 51 
 1.  Each hospital, birth center, and home birth provider 52 
providing maternity, prenatal, and newborn services shall 53 
provide the parent education materials to the parents or 54 
caregivers of a newborn within the first 2 week s after the birth 55 
of the infant. 56 
 2.  Childbirth educators, pediatric physician practices, 57 
home visiting programs, and obstetrician practices shall provide 58 
the parent education materials to the expectant parents or 59 
caregivers receiving education or health care services from them 60 
or, if parents or caregivers have already received the parent 61 
education materials, reiterate or reinforce the information 62 
covered by such materials. 63 
 3.  The department shall adopt a statewide multimedia 64 
public education campaign to prevent instances of abusive head 65 
trauma, including shaken baby syndrome, using the parent 66 
education materials adopted under subsection (1) or the 67 
information covered by the materials. 68 
 (b)  The department shall implement a mul ti-year phase-in 69 
plan for the distribution of the parent education materials, 70 
beginning with the counties with the six highest birth rates. 71 
 (3)  This section does not preclude a hospital, a birth 72 
center birthing facility, or a home birth provider , a childbirth 73 
educator, a pediatric physician practice, a home visiting 74 
program, or an obstetrician practice from providing the parent 75

education materials notice required under this section as an 76 
addendum to, or in connection with, any other required 77 
information. 78 
 (4)  A cause of action does not accrue against the state or 79 
any subdivision or agency thereof or any hospital , birth center, 80 
home birth birthing facility or home -birth provider, childbirth 81 
educator, pediatric physician practice, home visiting pro gram, 82 
or an obstetrician practice for failure to give or receive the 83 
information required under this section. 84 
 Section 2. This act shall take effect July 1, 2025. 85
