Statewide pawn data database feasibility 12 study.— 13 (1) As used in this section, the term: 14 (a) "Department" means the Department of Law Enforcement. 15 (b) "Pawn data" means information related to the 16 transactions of secondhand dealer s and secondary metals 17 recyclers, including pawn shops, that is required by chapter 538 18 and chapter 539, Florida Statutes, to be reported electronically 19 to law enforcement officials. This includes, but is not limited 20 to, descriptions of property, seller in formation, transaction 21 dates, and any other data related to the exchange of goods. 22 (2) The department shall conduct a feasibility study 23 regarding the creation of a statewide pawn data database which, 24 at a minimum, must: 25 CS/HB 1359 2025 CODING: Words stricken are deletions; words underlined are additions. hb1359-01-c1 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (a) Allow law enforcement agenci es in all counties in the 26 state to access, update, and share pawn data in real -time. 27 (b) Be provided free of charge to all law enforcement 28 agencies in the state. 29 (c) Be interoperable between different law enforcement 30 databases, software solutions, and jurisdictions and meet 31 established data standards to facilitate seamless communication 32 between law enforcement agencies. 33 (d) Ensure compliance with applicable privacy and security 34 laws. 35 (3) By January 1, 2026, the department must report to the 36 President of the Senate and the Speaker of the House of 37 Representatives the results of the feasibility study. 38 (4) This section is repealed upon submission of the study 39 under subsection (3). 40 Section 2. This act shall take effect July 1, 2025. 41
