applicability; amending s. 145.031, F.S.; revising 4 
requirements for the board of county commissioners 5 
salary formula to apply to noncharter counties; 6 
requiring the county population to be used to 7 
calculate the group rate beginning on a specified 8 
date; providing for the determination of salaries of 9 
members of boards of county commissioners of certain 10 
counties; amending s. 145.17, F.S.; providing 11 
applicability relating to the prohibition of 12 
supplemental compensation by certain counties ; 13 
amending s. 145.19, F.S.; providing procedures for 14 
calculating salary adjustments for members of boards 15 
of county commissioners of certain counties; creating 16 
s. 145.20, F.S.; requirin g a referendum for a board of 17 
county commissioners to increase the salary, 18 
retirement benefits, or other compensation paid to its 19 
members; requiring referendum election costs to be 20 
paid by the county; providing applicability; amending 21 
s. 166.021, F.S.; req uiring a referendum for the 22

district to increase the salary, retirement benefits, 29 
or other compensation paid to its members; requiring 30 
the referendum election costs to be paid by the 31 
special district; providing applicability; providing 32 
construction; providing an effective date. 33

Be It Enacted by the Legislature of the State of Florida: 35 
 36 
 Section 1.  Section 145.012, Florida Statutes, is amended 37 
to read: 38 
 145.012  Applicability. —This chapter applies to all 39 
officials herein designated in all counties of this the state, 40 
except those officials whose salaries are not subject to being 41 
set by the Legislature because of the provisions of a county 42 
home rule charter and except officials (other than the property 43 
appraiser, clerk of the circuit court, superintendent of 44 
schools, sheriff, supervisor of elections, and tax collector who 45 
if qualified shall receive in addition to their salaries a 46 
special qualification salary as provided in this chapter) of 47 
counties which have a chartered consolidated form of government 48 
as provided in chapter 67 -1320, Laws of Florida . 49 
 Section 2.  Section 145.031, Florida Statutes, is amended 50

 145.031  Board of county commissioners. — 52 
 (1)(a) Each member of the board of county commiss ioners of 53 
a noncharter county shall receive as salary the amount 54 
indicated, based on the population of his or her county. In 55 
addition, compensation shall be made for population increments 56 
over the minimum for each population group, which shall be 57 
determined by multiplying the population in excess of the 58 
minimum for the grouping times the group rate. 59

 (b)  Effective October 1, 2025, the population of the 70 
county as of April 1, 2025, shall be used to calculate the group 71 
rate under this subsection. 72 
 (2)  Each No member of a governing body of a charter 73 
chartered county or a county with a consolidated form of 74 
government shall receive as salary the amount provided by the 75 
provisions of the county charter as of September 30, 2025. If a 76 
county charter authorizes the governing body to set its salary 77 
by ordinance, each member of the governing body shall receive as 78 
salary the amount provided by an ordinance adopted on or before 79 
April 1, 2025. As of October 1, 2025, any future adjustment 80 
shall be made only as provided in s. 145.20 be deemed to be the 81 
equivalent of a county commissioner for the purposes of 82 
determining the compensation of such member under his or her 83 
respective charter. 84 
 (3)  Notwithstanding the provisions of this section or s. 85 
145.19, each member of the board of county commissioners may 86 
reduce his or her salary rate on a voluntary basis. 87 
 Section 3.  Section 145.17, Florida Statutes, is amended to 88 
read: 89 
 145.17  Supplemental compensation prohibited ; exception.—90

The compensation provided in chapter 145 shall be the sole and 91 
exclusive compensation of the officers whose salary is 92 
established therein for the execution of their official duties, 93 
and, except as specifically provided herein, the acceptance of 94 
salary for official duties as a result of other general or 95 
special law, general law of local application, resolution, or 96 
supplement or from any other source is a misdemeanor of the 97 
first degree punishable as provided in ss. 775.082 and 775.083. 98 
This section does not apply to any supplemental compensation 99 
provided by a charter county or a county with a consolidated 100 
form of government, provided that any increase in such 101 
supplemental compensation on or after October 1, 2025 , is made 102 
as provided in s. 145.20. 103 
 Section 4.  Subsection (2) of section 145.19, Florida 104 
Statutes, is amended, and subsection (3) is added to that 105 
section, to read: 106 
 145.19  Annual percentage increases based on increase for 107 
state career service employees; limitation ; exception.— 108 
 (2)  Each fiscal year, the salaries of all officials listed 109 
in this chapter, except boards of county commissioners, s. 110 
1001.395, and s. 1001.47 shall be adjusted. The adjusted salary 111 
rate shall be the product, rounded to the nearest dollar, of the 112 
salary rate granted by the appropriate section of this chapter, 113 
s. 1001.395, or s. 1001.47 multiplied first by the initial 114 
factor, then by the cumulative annual factor, and finally by the 115

annual factor. The Department of Management Services shall 116 
certify the annual factor and the cu mulative annual factors. Any 117 
special qualification salary received under this chapter, s. 118 
1001.47, or the annual performance salary incentive available to 119 
elected superintendents under s. 1001.47 shall be added to such 120 
adjusted salary rate. The special qua lification salary shall be 121 
$2,000, but may shall not exceed $2,000. 122 
 (3)  The salary adjustment for each member of a board of 123 
county commissioners of a noncharter county or a charter county 124 
that has adopted the salary rate for noncharter counties by 125 
charter or ordinance shall be calculated as provided in 126 
subsection (2) until September 30, 2025. As of October 1, 2025, 127 
any future adjustment shall be made only as provided in s. 128 
145.20. 129 
 Section 5.  Section 145.20, Florida Statutes, is created to 130 
read: 131 
 145.20  Referendum to increase salary, retirement benefits, 132 
or other compensation. — 133 
 (1)  A board of county commissioners may not increase the 134 
salary, any retirement benefit, or any other type of 135 
compensation paid to its members unless such increase is 136 
approved by a majority of the electors of the county voting in a 137 
referendum held at a general election during a presidential 138 
election year. The election costs of the referendum shall be 139 
paid by the county. 140

 (2)  This section does not apply to any increase in a 141 
retirement benefit received as part of the governing body's 142 
participation in the Florida Retirement System. 143 
 Section 6.  Subsection (10) is added to section 166.021, 144 
Florida Statutes, to read: 145 
 166.021  Powers.— 146 
 (10)(a)  The governing body of a municipalit y may not 147 
increase the salary, any retirement benefit, or any other type 148 
of compensation paid to its members unless such increase is 149 
approved by a majority of the electors of the municipality 150 
voting in a referendum held at a general election during a 151 
presidential election year. The election costs of the referendum 152 
shall be paid by the municipality. 153 
 (b)  This subsection does not apply to any increase in a 154 
retirement benefit received as part of the governing body's 155 
participation in the Florida Retirement System. 156 
 Section 7.  Section 189.0165, Florida Statutes, is created 157 
to read: 158 
 189.0165  Special districts; compensation of members of 159 
governing body.— 160 
 (1)  Notwithstanding any other provision of law, the 161 
governing body of a special district may not incr ease the 162 
salary, any pension or other retirement benefit, or any other 163 
type of compensation paid to members of the governing of a 164 
special district unless such increase is approved by a majority 165

of the electors of the special district voting in a referendum 166 
held at a general election during a presidential election year. 167 
The election costs of the referendum shall be paid by the 168 
special district. 169 
 (2)  This section does not apply to any increase in a 170 
retirement benefit received as part of the governing body's 171 
participation in the Florida Retirement System. 172 
 (3)  This section does not authorize a referendum to 173 
increase the salary, any pension or retirement benefit, or any 174 
other type of compensation paid to members of the governing body 175 
of a special district if t he special district's charter 176 
prohibits such members from receiving compensation or benefits. 177 
 Section 8. This act shall take effect October 1, 2025. 178
