A RESOLUTION
Ratifying Governor Brian P. Kemp's Executive Order Nos. 09.12.23.01, 10.06.23.01, and

11.08.23.01 suspending the collection of motor fuel and diesel fuel taxes; and for other2
purposes.3
WHEREAS, due to rampant inflation, the average price per gallon of regular unleaded gas4
and diesel fuel increased substantially; and5
WHEREAS, on September 12, 2023, under the authority granted in Code Section 38-3-516
of the Official Code of Georgia Annotated, Governor Brian P. Kemp declared a state of7
emergency for inflation and issued Executive Order No. 09.12.23.01 as necessary and8
appropriate action; and9
WHEREAS, the Governor renewed the state of emergency for inflation through November10
29, 2023, by issuing Executive Order Nos. 10.06.23.01 and 11.08.23.01; and 11
WHEREAS, pursuant to Code Section 45-12-22 of the Official Code of Georgia Annotated,12
under the state of emergency for inflation, the Governor suspended the collection of motor13
fuel and diesel fuel taxes required by Code Section 48-9-3 beginning on September 12, 2023,14
by issuing Executive Order No. 09.12.23.01; and15

WHEREAS, pursuant to Code Section 45-12-22 of the Official Code of Georgia Annotated,

the Governor continued the suspension of the collection of motor fuel and diesel taxes17
through November 29, 2023, due to the ongoing state of emergency for inflation by issuing18
Executive Order Nos. 10.06.23.01 and 11.08.23.01; and19
WHEREAS, pursuant to Code Section 45-12-22 of the Official Code of Georgia Annotated,20
action by two-thirds of the General Assembly is necessary to ratify the suspension of the21
collection of motor fuel and diesel fuel taxes as declared by Executive Order Nos.22
09.12.23.01, 10.06.23.01, and 11.08.23.01.23
NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF24
GEORGIA that the members of this body ratify the suspension of the collection of motor fuel25
and diesel fuel taxes as declared by Executive Order Nos. 09.12.23.01, 10.06.23.01, and26
11.08.23.01 issued by Governor Brian P. Kemp in response to a state of emergency for27
inflation.28
BE IT FURTHER RESOLVED that the Clerk of the House of Representatives and the29
Secretary of the Senate are authorized and directed to make appropriate copies of this30
resolution available for distribution to Governor Brian P. Kemp and members of the public31
and the press.32
