  The House Committee on Governmental Affairs offers the following substitute to HB 1039:
A BILL TO BE ENTITLED
AN ACT
To amend Article 2 of Chapter 5 of Title 21 of the Official Code of Georgia Annotated,1
relating to campaign contributions, so as to provide that candidates, campaign committees,2
independent committees, or political action committees shall require disclosures on content3
or postings made by social media personalities that are paid for by such candidate or4
committee; to provide a definition; to provide for related matters; to repeal conflicting laws;5
and for other purposes.6
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
SECTION 1.8
Article 2 of Chapter 5 of Title 21 of the Official Code of Georgia Annotated, relating to9
campaign contributions, is amended by adding a new Code section to read as follows:10
"21-5-37.11
(a)  As used in this Code section, the term 'social media personality' means a person, group12
of people, or business entity that creates or posts content, messages, information, or images13
that are viewable by other users on one or more social media platforms, as that term is14
defined in Code Section 50-29-20, in return for monetary or nonmonetary remuneration.15

(b)  In the event that a candidate, campaign committee, independent committee, or political16
action committee makes an expenditure to a social media personality in return for the17
posting of content, messages, information, or images, such candidate, campaign committee,18
independent committee, or political action committee shall require such social media19
personality to disclose that said content, messages, information, or images were paid for20
by said candidate, campaign committee, independent committee, or political action21
committee.22
(c)  The disclosure required by subsection (b) of this Code section shall be in writing and23
made verbally, when the respective media allows, and shall be made a part of each piece24
of content, messages, information, or images posted that was paid for by the candidate,25
campaign committee, independent committee, or political action committee and shall be26
clearly legible.  For the use of audible media it shall be announced, articulated, spoken, or27
otherwise rendered completely using the same volume and rate of speaking as is used in28
the remainder of the posting."29
SECTION 2.30
All laws and parts of laws in conflict with this Act are repealed.31
