A BILL TO BE ENTITLED
AN ACT
To amend Part 3 of Article 2 of Chapter 4 of Title 12 of the Official Code of Georgia

Annotated, relating to surface mining, so as to revise maximum criminal penalties for2
violations; to provide for related matters; to repeal conflicting laws; and for other purposes.3
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:4
SECTION 1.5
Part 3 of Article 2 of Chapter 4 of Title 12 of the Official Code of Georgia Annotated,6
relating to surface mining, is amended by revising Code Section 12-4-84, relating to criminal7
penalties, as follows:8
"12-4-84.9
Any person who engages in surface mining in violation of this part or who willfully10
misrepresents any fact in any matter required by this part or willfully gives false11
information in any application or report required by this part shall be guilty of a12
misdemeanor and, upon conviction thereof, shall be fined not less than $100.00 nor more13
than $1,000.00
 $10,000.00 for each offense. Each day of noncompliance after notification14
shall be considered a separate offense."15 23 LC 51 0312

SECTION 2.

All laws and parts of laws in conflict with this Act are repealed.17
