B. 664 - 1 - House Bill 664 By: Representative Stephens of the 164 th A BILL TO BE ENTITLED AN ACT To amend Code Section 47-2-101 of the Official Code of Georgia Annotated, relating to 1 creditable service in the Employees' Retirement System of Georgia for prior service as2 member of the Georgia Defined Contribution Plan, so as to allow for the purchase of up to3 18 months of creditable service in such retirement system based upon certain creditable4 service in such plan; to provide for related matters; to provide conditions for an effective date5 and automatic repeal; to repeal conflicting laws; and for other purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Code Section 47-2-101 of the Official Code of Georgia Annotated, relating to creditable9 service in the Employees Retirement System of Georgia for prior service as member of the10 Georgia Defined Contribution Plan, is amended by revising subsection (a) as follows:11 "(a) A member who was a member of the Georgia Defined Contribution Plan created by12 Chapter 22 of this title immediately prior to becoming a member of this retirement system13 shall be entitled to obtain creditable service in this retirement system for all such prior14 service with such Georgia Defined Contribution Plan employer, as well as up to 18 months 15 of any prior creditable service he or she earned with such Georgia Defined Contribution16 23 LC 43 2733 H. B. 664 - 2 - Plan employer that was noncontiguous with his or her period of employment immediately17 prior to becoming a member of this retirement system."18 SECTION 2.19 This Act shall become effective on July 1, 2024, only if it is determined to have been20 concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia21 Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not22 become effective and shall be automatically repealed in its entirety on July 1, 2024, as23 required by subsection (a) of Code Section 47-20-50.24 SECTION 3.25 All laws and parts of laws in conflict with this Act are repealed.26
