A BILL TO BE ENTITLED
AN ACT
To amend an Act providing for the election of members of the Board of Education of Cobb

County, approved March 28, 1974 (Ga. L. 1974, p. 3516), as amended, particularly by an Act2
approved March 2, 2022 (Ga. L. 2022, p. 5274), so as to change the description of the3
education districts of such board; to provide for definitions and inclusions; to provide for4
continuation in office of current members; to provide for the manner of election; to provide5
an effective date; to repeal a specific Act; to repeal conflicting laws; and for other purposes.6
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
SECTION 1.8
An Act providing for the election of members of the Board of Education of Cobb County,9
approved March 28, 1974 (Ga. L. 1974, p. 3516), as amended, particularly by an Act10
approved March 2, 2022 (Ga. L. 2022, p. 5274), is amended by revising subsections (a), (b),11
and (c) of Section 2 to read as follows:12
"SECTION 2.13
(a)(1) For the purpose of electing members of the Board of Education of Cobb County,14
the Cobb County School District is divided into seven education districts. The seven15
education districts shall be composed of and correspond to those seven numbered districts16

described in Appendix A attached to and made a part of this Act and further identified as
17
'User: S037 Plan Name: CobbSB-S037-2024 Plan Type: Local'.18
(2) For the purposes of such plan:19
(A) The term 'VTD' shall mean and describe the same geographical boundaries as20
provided in the report of the Bureau of the Census for the United States decennial21
census of 2020 for the State of Georgia. The separate numeric designations in a district22
description which are underneath a VTD heading shall mean and describe individual23
Blocks within a VTD as provided in the report of the Bureau of the Census for the24
United States decennial census of 2020 for the State of Georgia; and25
(B) Except as otherwise provided in the description of any district, whenever the26
description of any district refers to a named city, it shall mean the geographical27
boundaries of that city as shown on the census maps for the United States decennial28
census of 2020 for the State of Georgia.29
(3) Any part of the Cobb County School District which is not included in any district30
described in paragraph (1) of this subsection shall be included within that district31
contiguous to such part which contains the least population according to the United States32
decennial census of 2020 for the State of Georgia.33
(4) Any part of the Cobb County School District which is described in paragraph (1) of34
this subsection as being in a particular district shall nevertheless not be included within35
such district if such part is not contiguous to such district. Such noncontiguous part shall36
instead be included within that district contiguous to such part which contains the least37
population according to the United States decennial census of 2020 for the State of38
Georgia.39
(5) Education Districts 1, 2, 3, 4, 5, 6, and 7, as those districts exist immediately prior40
to the effective date of this Act, shall continue to be designated as Education41
Districts 1, 2, 3, 4, 5, 6, and 7, respectively, but as newly described under this Act, and42
on and after the effective date of this Act, such members of the board serving from those43

former education districts shall be deemed to be serving from and representing their
44
respective districts as newly described under this Act.45
(b) There shall be elected to the Board of Education of Cobb County one member from46
each education district. To be eligible for membership on the board to represent an47
education district, a person must reside in the education district which he or she represents. 48
Each member shall be elected only by the voters of that education district voting for such49
office and not by the voters of the entire county. No person residing within the territory50
embraced within an independent school system shall be eligible to vote in an election for51
members of the board, nor shall any such person be eligible to serve on the board. In order52
to be eligible as a member of the Board of Education of Cobb County, a candidate must be53
a resident of the education district from which he or she offers, must be a citizen of the54
United States of America, must have been a resident of the Cobb County School District55
for at least 12 months immediately preceding the date of the election, and must be a56
qualified elector of Cobb County.57
(c) Successors to members of the board whose terms of office are to expire shall be elected58
at the general election immediately preceding the expiration of such terms and shall take59
office the first day of January immediately following that election for terms of four years60
and until their successors are elected and qualified."61
SECTION 2.62
The provisions of this Act necessary to conduct elections for the members of the Board of63
Education of Cobb County in 2024 shall become effective upon the approval of this Act by64
the Governor or upon its becoming law without such approval. The remaining provisions65
of this Act shall become effective on January 1, 2025.66

An Act to amend an Act providing for the election of members of the Board of Education of

March 2, 2022 (Ga. L. 2022, p. 5274), is repealed in its entirety.70
SECTION 4.71
All laws and parts of laws in conflict with this Act are repealed.72
