LC 47 3103S The House Committee on Rules offers the following substitute to SB 341: A BILL TO BE ENTITLED AN ACT To amend various titles of the Official Code of Georgia Annotated so as to revise committee1 names; to repeal provisions relating to inactive boards, panels, authorities, centers,2 commissions, committees, councils, task forces, and other such bodies and certain procedures3 of the General Assembly; to make conforming changes throughout the Code; to revise certain4 provisions relating to the Legislative Services Committee; to revise provisions related to5 judicial continuances and stays related to the General Assembly; to revise provisions relating6 to the legislative fiscal office's scope of authority; to provide for related matters; to provide7 for an effective date; to repeal conflicting laws; and for other purposes.8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:9 PART I10 Senate Appropriations Subcommittee Name Correction11 SECTION 1-1.12 Title 2 of the Official Code of Georgia Annotated, relating to agriculture, is amended by13 revising paragraph (1) of subsection (a) of Code Section 2-10-53.1, relating to oversight by14 legislative advisory committee, membership, duties, and expiration, as follows:15 - 1 - LC 47 3103S "(1) The chairpersons of the House Appropriations Subcommittee for Economic16 Development and Tourism and the Senate Appropriations Subcommittee for Agriculture17 and Consumer Affairs Natural Resources or their designees, ex officio;"18 PART II19 Senate Committee Name Correction20 SECTION 2-1.21 Title 10 of the Official Code of Georgia Annotated, relating to commerce and trade, is22 amended by revising Code Section 10-9-20, relating to Geo. L. Smith II Georgia World23 Congress Center Authority Overview Committee created, composition, officers, and duties,24 as follows:25 "10-9-20.26 There is created as a joint committee of the General Assembly the Geo. L. Smith II Georgia27 World Congress Center Authority Overview Committee to be composed of five members28 of the House of Representatives appointed by the Speaker of the House, one of whom shall29 be a member of the minority party, five members of the Senate appointed by the Senate30 Committee on Assignments, one of whom shall be a member of the minority party, the31 chairperson of the House Committee on Economic Development and Tourism or his or her32 designee, and the chairperson of the Senate Economic Development Committee Senate33 Committee on Economic Development and Tourism or his or her designee. The members34 of the committee shall serve two-year terms concurrent with their terms as members of the35 General Assembly. The chairperson of the committee shall be appointed by the Senate36 Committee on Assignments from the membership of the committee, and the vice37 chairperson of the committee shall be appointed by the Speaker of the House from the38 membership of the committee. The chairperson and vice chairperson shall serve terms of39 two years concurrent with their terms as members of the General Assembly. Vacancies in40 - 2 - LC 47 3103S an appointed member's position or in the offices of chairperson or vice chairperson of the41 committee shall be filled for the unexpired term in the same manner as the original42 appointment. The committee shall periodically inquire into and review the operations of43 the Geo. L. Smith II Georgia World Congress Center Authority, as well as periodically44 review and evaluate the success with which the authority is accomplishing its statutory45 duties and functions as provided in this chapter."46 PART III47 Georgia Education Authority (Schools)48 SECTION 3-1.49 Title 20 of the Official Code of Georgia Annotated, relating to education, is amended in50 Article 11 of Chapter 2, relating to public school property and facilities, by repealing Part 3,51 relating to the Georgia Education Authority (Schools), and designating said part as reserved.52 SECTION 3-2.53 Said title is further amended in Code Section 20-3-152, relating to the Georgia Education54 Authority (University) creation, members, officers, and staff, quorum, procedural rules and55 regulations, and assignment to Department of Administrative Services, by revising56 subsection (b) as follows:57 "(b) The authority shall elect one of its members as chairman chairperson and another as58 vice-chairman vice chairperson and a secretary and treasurer, who need not necessarily be59 a member of the authority but who shall be the same as the secretary and treasurer of the60 Georgia Education Authority (Schools). The majority of the members of the authority shall61 constitute a quorum. No vacancy on the authority shall impair the right of the quorum to62 exercise all the rights and perform all the duties of the authority. The members of the63 authority shall not be entitled to compensation for their services but shall be entitled to and64 - 3 - LC 47 3103S shall be reimbursed for their actual expenses necessarily incurred in the performance of65 their duties. The staff of the authority shall be the same as the staff of the Georgia66 Education Authority (Schools). The authority shall make rules and regulations for its own67 government. It shall have perpetual existence. Any change in name or composition of the68 authority shall in no way affect the vested rights of any person under the provisions of this69 article or impair the obligations of any contracts existing under this article."70 SECTION 3-3.71 Title 29 of the Official Code of Georgia Annotated, relating to guardian and ward, is72 amended in Code Section 29-3-32, relating to investment of funds, by repealing73 paragraph (8) and designating said paragraph as reserved.74 SECTION 3-4.75 Said title is further amended in Code Section 29-5-32, relating to investment of estate funds76 by conservator, by repealing paragraph (8) and designating said paragraph as reserved.77 SECTION 3-5.78 Title 45 of the Official Code of Georgia Annotated, relating to public officers and employees,79 is amended by revising Code Section 45-15-13, relating to representation of state authorities80 by Attorney General, as follows:81 "45-15-13.82 As used in Code Sections 45-15-14 through 45-15-16, the term 'state authorities' means the83 following instrumentalities of the state: Georgia Building Authority, Georgia Education84 Authority (Schools), Georgia Education Authority (University), Georgia Highway85 Authority, Georgia Ports Authority, State Road and Tollway Authority, Jekyll86 Island—State Park Authority, Stone Mountain Memorial Association, Georgia Emergency87 Communications Authority, and Savannah-Georgia Convention Center Authority."88 - 4 - LC 47 3103S SECTION 3-6.89 Title 50 of the Official Code of Georgia Annotated, relating to state government, is amended90 in Code Section 50-17-21, relating to definitions, by revising paragraph (9) as follows:91 "(9) 'State authorities' means the following instrumentalities of the state: Georgia92 Building Authority, Georgia Education Authority (Schools), Georgia Education Authority93 (University), Georgia Highway Authority, State Road and Tollway Authority, Georgia94 Ports Authority, Georgia Development Authority, Jekyll Island—State Park Authority,95 Stone Mountain Memorial Association, North Georgia Mountains Authority, Lake Lanier96 Islands Development Authority, Groveland Lake Development Authority, Georgia97 Higher Education Assistance Authority, the Georgia Housing and Finance Authority, and98 other instrumentalities of the state created by the General Assembly and authorized to99 issue debt and not specifically exempt from this article."100 SECTION 3-7.101 Said title is further amended in Code Section 50-17-22, relating to State Financing and102 Investment Commission, by revising paragraph (2) of subsection (b) as follows:103 "(2) There shall be a construction division of the commission administered by a director104 who shall not be a member of the commission and who shall also serve as the executive105 secretary for the commission. The director and the staff of the construction division shall106 be appointed by and serve at the pleasure of the commission, shall provide administrative107 support for all personnel of the commission, and shall account for and keep all records108 pertaining to the operation and administration of the commission and its staff. The109 director, as executive secretary, shall prepare agendas and keep minutes of all meetings110 of the commission. In construction and construction related matters, the construction111 division shall act in accordance with the policies, resolutions, and directives of the112 Georgia Education Authority (Schools) and the Georgia Education Authority (University)113 until such time as such policies, resolutions, or directives are changed or modified by the114 - 5 - LC 47 3103S commission. In carrying out its responsibilities in connection with the application of any115 funds under its control, including the proceeds of any debt or any appropriation made116 directly to it for construction purposes, the commission is specifically authorized to117 acquire and construct projects for the benefit of any department or agency of the state or118 to contract with any such department or agency for the acquisition or construction of119 projects under policies, standards, and operating procedures to be established by the120 commission; provided, however, that the commission shall contract with the Department121 of Transportation or the Georgia Highway Authority or the State Road and Tollway122 Authority or any combination of the foregoing for the supervision of and contracting for123 design, planning, building, rebuilding, constructing, reconstructing, surfacing,124 resurfacing, laying out, grading, repairing, improving, widening, straightening, operating,125 owning, maintaining, leasing, and managing any public roads and bridges for which126 general obligation debt has been authorized. The construction division also shall perform127 such construction related services and grant administration services for state agencies and128 instrumentalities and for local governments, instrumentalities of local governments, and129 other political subdivisions as may be assigned to the commission or to the construction130 division by executive order of the Governor."131 SECTION 3-8.132 Any assets of the Georgia Education Authority (Schools) existing as of June 30, 2024, shall133 devolve by operation of law and without further action to the State of Georgia on July 1,134 2024, and any real property held, owned, or under the custody or control of the Georgia135 Education Authority (Schools) shall constitute property as defined in paragraph (8) of Code136 Section 50-16-31. Any liabilities and obligations of the Georgia Education Authority137 (Schools) existing as of June 30, 2024, shall be transferred and assumed by the State of138 Georgia, by such instruments as may be required to maintain the same.139 - 6 - LC 47 3103S PART IV140 General Assembly141 SECTION 4-1.142 Title 28 of the Official Code of Georgia Annotated, relating to the General Assembly, is143 amended by repealing Code Section 28-1-17, relating to prefiling of proposed bills and144 resolutions prior to each legislative session and administrative procedure.145 SECTION 4-2.146 Said title is further amended in Code Section 28-3-24.1, relating to public distribution of147 legislative information in electronic format, by revising subsection (b) as follows:148 "(b) The Secretary of the Senate and the Clerk of the House of Representatives may149 provide legislative information in electronic format to the GeorgiaNet Division of the150 Georgia Technology Authority for purposes of public distribution as provided in Code151 Section 50-25-14. The information may be provided on at least a daily basis in the most152 current format available. The information provided may include at a minimum: available153 schedules and agenda for committee meetings; available bill and resolution status154 information; and full text of all available prefiled and introduced versions of bills and155 resolutions, including amendments and substitutes. The information provided may include156 such other matters as will in the determination of the Secretary and the Clerk contribute to157 the purposes of this Code section. The Georgia Technology Authority shall work with the158 General Assembly to develop a single Internet site public website for the Georgia General159 Assembly. The content and the format of the General Assembly Internet site public160 website shall be determined by the Legislative Services Committee."161 - 7 - LC 47 3103S SECTION 4-3.162 Said title is further amended by revising Code Section 28-4-3.1, relating to confidentiality163 of communications between Office of Legislative Counsel and certain persons, as follows:164 "28-4-3.1. 165 Communications between the Office of Legislative Counsel or any individual or office166 provided for in Code Section 28-4-5.1 and the following persons shall be privileged and167 confidential: members, officers, and staff of the General Assembly, including the168 Lieutenant Governor President of the Senate, and persons acting on their behalf of such169 public officers; and such communications, and records and work product relating to such170 communications, shall not be subject to inspection or disclosure under Article 4 of Chapter171 18 of Title 50 or any other law or under judicial process; provided, however, that this172 privilege shall not apply where it is waived by the affected public officer or officers. The173 privilege established under this Code section is in addition to any other constitutional,174 statutory, or common law privilege."175 SECTION 4-4.176 Said title is further amended by revising Code Section 28-4-5, relating to the Attorney177 General to serve as advisor to legislative counsel, as follows: 178 "28-4-5.179 (a) The Attorney General shall serve as an advisor to the legislative counsel and any180 individual provided for in Code Section 28-4-5.1 and shall represent the General Assembly181 and its members, officers, or staff upon request of the legislative counsel or any individual182 provided for in Code Section 28-4-5.1 unless there is a legal conflict.183 (b) The Department of Administrative Services may provide contract review and drafting184 services and other services to the General Assembly upon request by the Office of185 Legislative Counsel or any individual provided for in Code Section 28-4-5.1.186 - 8 - LC 47 3103S (c) Any communications, records, and work product relating to such advice,187 communications, and services provided pursuant to this Code section shall not be subject188 to inspection or disclosure under Article 4 of Chapter 18 of Title 50 or any other law or189 under any judicial process. Such privilege from disclosure shall be in addition to any other190 constitutional, statutory, or common law privilege."191 SECTION 4-5.192 Said title is further amended by adding a new Code section to read as follows:193 "28-4-5.1.194 (a) The Legislative Services Committee may assign to one or more legislative staff195 members or to an office the duty to provide and oversee the provision of legal services for196 the legislative branch of government and, with the approval of the committee or the197 chairperson, to represent the interests of the legislative branch in matters involving198 litigation and as to legislation that may affect the legislative branch and to perform any199 other assigned duties.200 (b) The provisions of this Code section shall not be construed to impair or limit the duties201 or authority of the legislative counsel or the Office of Legislative Counsel as provided by202 law."203 SECTION 4-6.204 Said title is further amended in Code Section 28-4-6, relating to employment, powers, and205 duties of legislative fiscal officer, by revising subsection (b) as follows:206 "(b) The legislative fiscal officer is authorized on behalf of the legislative branch to pay207 any properly authorized invoice which does not exceed $5,000.00; provided, however, that208 the legislative fiscal officer shall be authorized to pay any invoice for fees incurred for209 legal services not to exceed $12,000.00. Any invoice which exceeds $5,000.00, or210 $12,000.00 for fees incurred for legal services, shall may not be paid by such fiscal officer211 - 9 - LC 47 3103S without prior approval from the committee. The committee may provide for such approval212 to be given at meetings of the committee, or in writing between meetings by a majority of213 the members of the committee, or in such other manner as the committee may establish. 214 All invoices shall contain in detail a description of the work performed, materials used or215 purchased, and any other information pertinent to the obligation. Before the fiscal officer216 may pay any invoice, a requisition or purchase order covering such invoice and signed by217 the person or persons authorized by the Legislative Services Committee to do so plus218 evidence of delivery must have been submitted to the fiscal officer. A list of all invoices219 which have been paid shall be submitted by the fiscal officer to the committee on a220 monthly basis."221 SECTION 4-7.222 Code Section 9-10-150 of the Official Code of Georgia Annotated, relating to grounds for223 continuance and stay — attendance of party or attorney in General Assembly, writing224 requirement, and considerations, is amended by revising subsection (a) as follows:225 "(a) A member of the General Assembly who is a party to or the attorney for a party to a226 case; any member of the Office of Legislative Counsel, including the legislative counsel227 and persons provided for under subsection (d) of Code Section 28-4-3, appearing on behalf228 of the General Assembly or any member, officer, or staff thereof in a case; any individual229 or member of the office provided for in Code Section 28-4-5.1, appearing on behalf of the230 General Assembly or any member, officer, or staff thereof in a case; or any member of the231 staff of the Lieutenant Governor, the Speaker of the House of Representatives, the232 President Pro Tempore of the Senate, the Speaker Pro Tempore of the House of233 Representatives, or the chairperson of the Judiciary Committee or Special Judiciary234 Committee of the Senate or of the Judiciary Committee or Judiciary, Non-civil Committee235 of the House of Representatives who is the lead counsel for a party to a case pending in any236 trial or appellate court or before any administrative agency of this state, shall be granted237 - 10 - LC 47 3103S a continuance and stay of the case. The continuance and stay shall apply to all aspects of238 the case, including, but not limited to, the filing and serving of an answer to a complaint,239 the making of any discovery or motion, or of any response to any subpoena, discovery, or240 motion, and appearance at any hearing, trial, or argument. Unless a shorter length of time241 is requested by the member, the continuance and stay shall last for the seven days prior to242 the regular or extraordinary session of the General Assembly; the length of any regular or243 extraordinary session of the General Assembly; during the first three weeks following any244 recess or adjournment, including an adjournment sine die of any regular or extraordinary245 session; and the entirety of any day during the calendar year on which a legislative246 committee for which the member serves or is staff holds a scheduled meeting, the member247 attends a national legislative conference or board meeting, the member attends a caucus248 meeting, or the member attends a meeting of a study committee of the General Assembly. 249 Notwithstanding any other provision of law, rule of court, or administrative rule or250 regulation, the time for doing any act in the case which is delayed by the continuance251 provided by this Code section shall be automatically extended by the same length of time252 as the continuance or stay covered." 253 SECTION 4-8.254 Code Section 17-8-26 of the Official Code of Georgia Annotated, relating to party or party's255 attorney in attendance at General Assembly as grounds for granting continuance, is amended256 by revising subsection (a) as follows:257 "(a) A member of the General Assembly who is a party to or the attorney for a party to a258 case; any member of the Office of Legislative Counsel, including the legislative counsel259 and persons provided for under subsection (d) of Code Section 28-4-3, appearing on behalf260 of the General Assembly or any member, officer, or staff thereof in a case; any individual261 or member of the office provided for in Code Section 28-4-5.1, appearing on behalf of the262 General Assembly or any member, officer, or staff thereof in a case; or any member of the263 - 11 - LC 47 3103S staff of the Lieutenant Governor, the Speaker of the House of Representatives, or the264 chairperson of the Judiciary Committee or Special Judiciary Committee of the Senate or265 of the Judiciary Committee or Judiciary, Non-civil Committee of the House of266 Representatives who is the lead counsel for a party to a case pending in any trial or267 appellate court or before any administrative agency of this state shall be granted a268 continuance and stay of the case. The continuance and stay shall apply to all aspects of the269 case, including, but not limited to, the filing and serving of an answer to a complaint, the270 making of any discovery or motion, or of any response to any subpoena, discovery, or271 motion, and appearance at any hearing, trial, or argument. Unless a shorter length of time272 is requested by the member, the continuance and stay shall last for the seven days prior to273 the regular or extraordinary session of the General Assembly; the length of any regular or274 extraordinary session of the General Assembly; during the first three weeks following any275 recess or adjournment, including an adjournment sine die of any regular or extraordinary276 session; and the entirety of any day during the calendar year on which a legislative277 committee for which the member serves or is staff holds a scheduled meeting. 278 Notwithstanding any other provision of law, rule of court, or administrative rule or279 regulation, and to the extent permitted by the Constitutions of the United States and of the280 State of Georgia, the time for doing any act in the case which is delayed by the continuance281 or stay provided by this Code section shall be automatically extended by the same length282 of time as the continuance or stay covered."283 PART V284 Legislative Services Committee285 SECTION 5-1.286 Title 28 of the Official Code of Georgia Annotated, relating to the General Assembly, is287 amended in Chapter 4, relating to legislative services, by revising Code Section 28-4-1,288 - 12 - LC 47 3103S relating to the Legislative Services Committee, creation, membership, compensation, and289 members, as follows:290 "28-4-1.291 (a) There is created the Legislative Services Committee, hereinafter called the committee,292 to be composed of the:293 (1) Speaker of the House of Representatives, the;294 (2) President of the Senate, the;295 (3) Chairperson chairperson of the Appropriations Committee of the Senate, the;296 (4) Chairperson chairperson of the Appropriations Committee of the House of297 Representatives, the;298 (5) Chairperson chairperson of the Judiciary Committee of the Senate, the;299 (6) Chairperson chairperson of the Judiciary Committee of the House of Representatives,300 the;301 (7) Chairperson chairperson of the Banking and Financial Institutions Committee of the302 Senate, the;303 (8) Chairperson chairperson of the Ways and Means Committee of the House of304 Representatives, the;305 (9) President Pro Tempore of the Senate, the;306 (10) Speaker Pro Tempore of the House of Representatives, the;307 (11) Majority majority leader of the Senate, the;308 (12) Majority majority leader of the House of Representatives, the;309 (13) Minority minority leader of the Senate, the;310 (14) Minority minority leader of the House of Representatives, the;311 (15) Secretary of the Senate, and the; and312 (16) Clerk of the House of Representatives. The Speaker of the House of313 Representatives shall be chairperson of the committee, and the Secretary of the Senate314 shall be secretary of the committee.315 - 13 - LC 47 3103S (b) The Speaker of the House of Representatives and the President Pro Tempore of the316 Senate shall be cochairpersons; provided, however, that the Speaker of the House of317 Representatives shall be the presiding chairperson of the committee each odd-numbered318 year, and the President Pro Tempore of the Senate shall be the presiding chairperson of the319 committee each even-numbered year. The President of the Senate shall at all times serve320 as the vice chairperson.321 (c) The Secretary of the Senate shall be secretary of the committee each odd-numbered322 year and the Clerk of the House of Representatives shall be the secretary of the committee323 each even-numbered year.324 (b)(d) The members of the committee shall receive no additional allowances for service325 on the committee while the General Assembly is in session; but, for each day spent in the326 performance of their duties under this chapter between sessions, the members shall receive327 the allowances authorized by law for legislative members of interim legislative committees.328 (c)(e) The committee shall meet at least twice during each calendar year. Additional329 meetings may be held upon the call of the presiding chairperson or upon the call of a330 majority of the members of the committee. Nine members of the committee shall331 constitute a quorum and the affirmative vote of a majority of those members present at a332 meeting of the committee, provided such members present constitute a quorum, shall be333 necessary to transact business of the committee. The Every member of the committee334 including the presiding chairperson shall be entitled to vote on all matters requiring a vote335 of the committee. In the event that the presiding chairperson for the then-current year is336 unable to chair a called meeting of the committee, the committee shall be chaired by the337 other cochairperson."338 - 14 - LC 47 3103S SECTION 5-2.339 Said title is further amended in Code Section 28-4-3, relating to Office of Legislative340 Counsel, creation, qualifications, and powers and duties, by revising paragraph (4) of341 subsection (c) as follows:342 "(4) Provide legal services for the legislative branch of government and, with the343 approval of the committee or the chairman presiding chairperson of such committee, to344 represent the interests of the legislative branch in matters involving litigation; and"345 PART VI346 Georgia Rail Passenger Authority Overview Committee347 SECTION 6-1.348 Title 28 of the Official Code of Georgia Annotated, relating to the General Assembly, is349 amended by repealing Chapter 10, relating to the Georgia Rail Passenger Authority350 Overview Committee, and designating said chapter as reserved.351 SECTION 6-2.352 Any assets of the Georgia Rail Passenger Authority Overview Committee existing as of June353 30, 2024, shall devolve by operation of law and without further action to the State of Georgia354 on July 1, 2024. Any liabilities and obligations of the Georgia Rail Passenger Authority355 Overview Committee existing as of June 30, 2024, shall be transferred and assumed by the356 State of Georgia, by such instruments as may be required to maintain the same.357 - 15 - LC 47 3103S PART VII358 Reports of the Office of Health Strategy and Coordination359 SECTION 7-1.360 Title 31 of the Official Code of Georgia Annotated, relating to health, is amended by revising361 Code Section 31-53-6, relating to the compiling of reports and public dissemination of data,362 as follows:363 "31-53-6.364 (a) The office shall compile reports received from the following boards, commissions,365 committees, councils, and offices pursuant to each such entity's respective statutory366 reporting requirements:367 (1) The Maternal Mortality Review Committee;368 (2) The Office of Women's Health;369 (3) The Kidney Disease Advisory Committee;370 (4)(2) The Hemophilia Advisory Board;371 (5)(3) The Georgia Council on Lupus Education and Awareness;372 (6)(4) The Georgia Palliative Care and Quality of Life Advisory Council;373 (7)(5) The Georgia Trauma Care Network Commission;374 (8)(6) The Behavioral Health Coordinating Council;375 (9)(7) The Department of Public Health on behalf of the Georgia Coverdell Acute Stroke376 Registry;377 (10)(8) The Office of Cardiac Care; and378 (11)(9) The Brain and Spinal Injury Trust Fund Commission.379 (b) The office shall maintain a website that permits public dissemination of data compiled380 by the boards, commissions, committees, councils, and offices listed in subsection (a) of381 this Code section."382 - 16 - LC 47 3103S PART VIII383 Partnership for Public Facilities and Infrastructure Act Guidelines Committee384 SECTION 8-1.385 Title 36 of the Official Code of Georgia Annotated, relating to local government, is amended386 by repealing Code Section 36-91-111, relating to the creation and administration of the387 Partnership for Public Facilities and Infrastructure Act Guidelines Committee, and388 designating said Code section as reserved.389 SECTION 8-2.390 Said title is further amended in Code Section 36-91-112, relating to model guidelines, by391 revising subsection (a) as follows:392 "(a) Prior to executing any comprehensive agreement for the development or operation of393 a qualifying project pursuant to an unsolicited proposal received by a local government394 under this article, the local government shall adopt either:395 (1) The model guidelines from the Partnership for Public Facilities and Infrastructure Act396 Guidelines Committee; or397 (2) Its its own guidelines as a policy, rule, regulation, or ordinance, which shall contain398 each of the factors identified in subsection (b) of this Code section."399 PART IX400 Georgia World War I Centennial Commission401 SECTION 9-1.402 Title 45 of the Official Code of Georgia Annotated, relating to public officers and employees,403 is amended by repealing Article 3 of Chapter 13, relating to the Georgia World War I404 Centennial Commission, and designating said article as reserved.405 - 17 - LC 47 3103S SECTION 9-2.406 Any assets of the Georgia World War I Centennial Commission existing as of June 30, 2024,407 shall devolve by operation of law and without further action to the State of Georgia on July408 1, 2024. Any liabilities and obligations of the Georgia World War I Centennial Commission409 existing as of June 30, 2024, shall be transferred and assumed by the State of Georgia, by410 such instruments as may be required to maintain the same.411 PART X412 State Personnel Oversight Commission413 SECTION 10-1.414 Title 45 of the Official Code of Georgia Annotated, relating to public officers and employees,415 is amended by repealing Chapter 24, relating to the "Governmental Reorganization and416 Termination from Employment Reform Act of 1977."417 SECTION 10-2.418 Any assets of the State Personnel Oversight Commission existing as of June 30, 2024, shall419 devolve by operation of law and without further action to the State of Georgia on July 1,420 2024. Any liabilities and obligations of the State Personnel Oversight Commission existing421 as of June 30, 2024, shall be transferred and assumed by the State of Georgia, by such422 instruments as may be required to maintain the same.423 - 18 - LC 47 3103S PART XI424 Small Business Assistance Advisory Council425 SECTION 11-1.426 Title 50 of the Official Code of Georgia Annotated, relating to state government, is amended427 by repealing Part 3 of Article 3 of Chapter 5, relating to small business assistance, and428 designating said part as reserved.429 PART XII430 Commission on Regional Planning431 SECTION 12-1.432 Said title is further amended by repealing Part 2 of Article 2 of Chapter 8, relating to the433 Commission on Regional Planning.434 SECTION 12-2.435 Any assets of the Commission on Regional Planning existing as of June 30, 2024, shall436 devolve by operation of law and without further action to the State of Georgia on July 1,437 2024. Any liabilities and obligations of the Commission on Regional Planning existing as438 of June 30, 2024, shall be transferred and assumed by the State of Georgia, by such439 instruments as may be required to maintain the same.440 - 19 - LC 47 3103S PART XIII441 Commission on the Preservation of the State Capitol442 SECTION 13-1.443 Title 50 of the Official Code of Georgia Annotated, relating to state government, is amended444 by repealing Code Section 50-16-5.1, relating to the Commission on the Preservation of the445 State Capitol.446 SECTION 13-2.447 Title 45 of the Official Code of Georgia Annotated, relating to public officers and employees,448 is amended in Code Section 45-13-72, relating to submission of recommendations to achieve449 highest museum standards, and designation of area as Georgia Capitol Agricultural History450 Museum, by revising subsection (b) as follows:451 "(b) The Capitol Art Standards Commission, in cooperation with the Board of Regents of452 the University System of Georgia and the Commission on the Preservation of the State453 Capitol, shall designate areas within the capitol museum as the Georgia Capitol454 Agricultural History Museum areas. Such areas shall include information, artifacts,455 photographs, monuments, or other related items which tell the history and importance of456 agriculture to this state's economic growth. Except as provided for in this part, the Georgia457 Capitol Agricultural History Museum areas of the capitol museum shall be maintained,458 operated, and managed in the same manner as the other areas of the capitol museum."459 SECTION 13-3.460 Any assets of the Commission on the Preservation of the State Capitol existing as of June 30,461 2024, shall devolve by operation of law and without further action to the State of Georgia on462 July 1, 2024. Any liabilities and obligations of the Commission on the Preservation of the463 - 20 - LC 47 3103S State Capitol existing as of June 30, 2024, shall be transferred and assumed by the State of464 Georgia, by such instruments as may be required to maintain the same.465 PART XIV466 Senate Committee Name Correction467 SECTION 14-1.468 Title 50 of the Official Code of Georgia Annotated, relating to state government, is amended469 by revising subsection (a) of Code Section 50-27-34, relating to the Georgia Lottery470 Corporation Legislative Oversight Committee, as follows:471 "(a) There is created as a joint committee of the General Assembly, the Georgia Lottery472 Corporation Legislative Oversight Committee, to be composed of the members of the473 House Committee on Regulated Industries and the Senate Economic Development474 Committee Senate Committee on Economic Development and Tourism. The chairpersons475 of such committees shall serve as cochairpersons of the oversight committee. The476 oversight committee shall periodically inquire into and review the operations of the477 Georgia Lottery Corporation, as well as periodically review and evaluate the success with478 which the authority corporation is accomplishing its statutory duties and functions as479 provided in this chapter. The oversight committee may conduct any independent audit or480 investigation of the authority corporation it deems necessary."481 PART XV482 Effective Dates483 SECTION 15-1.484 (a) The provisions of Part V of this Act shall become effective on January 1, 2025.485 - 21 - LC 47 3103S (b) Except as provided in subsection (a) of this section, this Act shall become effective upon486 its approval by the Governor or upon its becoming law without such approval.487 PART XVI488 General Repealer489 SECTION 16-1.490 All laws and parts of laws in conflict with this Act are repealed.491 - 22 -
