A BILL TO BE ENTITLED
AN ACT
To amend an Act creating a board of commissioners for Banks County, approved August 19,

(Ga. L. 1916, p. 349), as amended, particularly by an Act approved February 17, 20222
(Ga. L. 2022, p. 4500), so as to change the description of the commissioner districts; to3
provide for definitions and inclusions; to provide for the continuation in office of current4
members; to provide for effective dates; to provide for related matters; to repeal conflicting5
laws; and for other purposes.6
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7
SECTION 1.8
Act creating a board of commissioners for Banks County, approved August 19, 19169
(Ga. L. 1916, p. 349), as amended, particularly by an Act approved February 17, 202210
(Ga. L. 2022, p. 4500), is amended by revising Section 2 as follows:11
"SECTION 2.12
(a) For the purpose of electing members of the board of commissioners, Banks County13
shall be divided into five commissioner districts. Commissioner Districts 1, 2, 3, and 414

shall be and correspond to those four numbered districts described in Appendix A, attached

to and made a part of this Act and further identified as 'User: Banks CC Plan Name:16
BanksCC-2025 Plan Type: Local'. Commissioner District 5 shall be comprised of the17
entire geographic area of Banks County.18
(b)(1) For the purposes of such plan:19
(A) The term 'VTD' shall mean and describe the same geographical boundaries as20
provided in the report of the Bureau of the Census for the United States decennial21
census of 2020 for the State of Georgia. The separate numeric designations in a district22
description which are underneath a VTD heading shall mean and describe individual23
Blocks within a VTD as provided in the report of the Bureau of the Census for the24
United States decennial census of 2020 for the State of Georgia; and25
(B) Except as otherwise provided in the description of any district, whenever the26
description of any district refers to a named city, it shall mean the geographical27
boundaries of that city as shown on the census maps for the United States decennial28
census of 2020 for the State of Georgia.29
(2) Any part of Banks County which is not included in any district described in30
subsection (a) of this section shall be included within that district contiguous to such part31
which contains the least population according to the United States decennial census32
of 2020 for the State of Georgia.33
(3) Any part of Banks County which is described in subsection (a) of this section as34
being included in a particular district shall nevertheless not be included within such35
district if such part is not contiguous to such district. Such noncontiguous part shall36
instead be included within that district contiguous to such part which contains the least37
population according to the United States decennial census of 2020 for the State of38
Georgia."39

SECTION 2.

(a) Those members of the Board of Commissioners of Banks County who are serving as41
such on the effective date of this Act and any person selected to fill a vacancy in any such42
office shall continue to serve as such members until the regular expiration of their respective43
terms of office and upon the election and qualification of their respective successors.44
(b) Commissioner Districts 1, 2, 3, and 4, as they exist immediately prior to the effective45
date of this Act, shall continue to be designated as Commissioner Districts 1, 2, 3, and 4,46
respectively, but as newly described under this Act, and on and after the effective date of this47
Act, such members of the board serving from those former commissioner districts shall be48
deemed to be serving from and representing their respective districts as newly described49
under this Act.50
SECTION 3.51
This Act shall become effective upon its approval by the Governor or upon its becoming law52
without such approval.53
SECTION 4.54
All laws and parts of laws in conflict with this Act are repealed.55
