25 LC 57 0236 House Bill 751 By: Representatives Campbell of the 35 th , Miller of the 62 nd , Evans of the 57 th , Lupton of the 83 rd , Buckner of the 137 th , and others A BILL TO BE ENTITLED AN ACT To amend Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, 1 relating to medical assistance generally, so as to authorize the Department of Community2 Health to submit a Section 1115 waiver request to the United States Department of Health3 and Human Services Centers for Medicare and Medicaid Services; to authorize additional4 qualifying activity types; to provide for definitions; to provide for related matters; to provide5 for an effective date; to repeal conflicting laws; and for other purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, relating to9 medical assistance generally, is amended by adding a new Code section to read as follows:10 "49-4-142.6. 11 The department shall be authorized to submit a waiver request, on or before September 30,12 2025, to the United States Department of Health and Human Services Centers for Medicare13 and Medicaid Services pursuant to Section 1115 of the federal Social Security Act, which14 includes childcare and caregiving as qualifying activities. For purposes of this Code15 section, the term 'childcare' means full-time or part-time work by a parent caring for a child16 H. B. 751 - 1 - 25 LC 57 0236 or children, in their own residence; and the term 'caregiving' means full-time or part-time17 work by a family member caring for an adult child with a disability or an aging parent. 18 Further, upon approval of the waiver, the department shall be authorized to take all19 necessary steps to implement the terms and conditions of the waiver."20 SECTION 2.21 This Act shall become effective upon its approval by the Governor or upon its becoming law22 without such approval.23 SECTION 3.24 All laws and parts of laws in conflict with this Act are repealed.25 H.
