A BILL TO BE ENTITLED
AN ACT
To amend Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to selling

and other trade practices, so as to extend certain protections for consumers relative to2
warranties of HVAC systems and components of such systems; to allow for transfers of3
certain manufacturers' warranties of HVAC systems and components of such systems; to4
prohibit manufacturers', distributors', and retailers' warranties of HVAC systems and5
components of such systems from being conditioned upon product registration; to provide6
required information for warranty and product registration cards and forms; to provide an7
effective date for certain warranties of HVAC systems and components of such systems; to8
provide a definition; to provide for an effective date and applicability; to provide for related9
matters; to repeal conflicting laws; and for other purposes.10
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:11
SECTION 1.12
Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to selling and other13
trade practices, is amended by adding a new article to read as follows:14

As used in this article, the term 'HVAC' means heating, ventilation, and air-conditioning.17
10-1-961.18
(a)  If a residential real property that includes an HVAC system as a fixture to the property19
is conveyed to a new owner, any manufacturer's warranty in effect on that system or any20
component of that system:21
(1)  Shall be automatically transferred to the new owner; and22
(2)  Shall continue in effect as if the new owner was the original purchaser of such system23
or component, as applicable.24
(b) A manufacturer shall continue to be obligated under the terms of any warranty25
transferred pursuant to subsection (a) of this Code section and shall not charge a fee for the26
transfer of such warranty.27
(c)  A transfer of any manufacturer's warranty pursuant to subsection (a) of this Code28
section shall not extend the remaining term of the warranty.29

(a)  The full term of a manufacturer's, distributor's, or retailer's warranty of an HVAC31
system or any component of such system shall be effective in this state on the date of32
installation if installed by a contractor licensed under Chapter 14 of Title 43.33
(b)  If a manufacturer, distributor, or retailer of an HVAC system or any component of such34
system provides a warranty or product registration card or form, or an electronic, online35
warranty or product registration form, the card or form shall contain the following36
information, displayed in a clear and conspicuous manner:37
(1)  The card or form is for registration of the product; and38

(2)  Failure to complete and return the card or form shall not diminish any warranty rights39
or decrease the warranty term.40
(c)  Any warranty of an HVAC system or any component of such system manufactured and41
issued, sold, or offered for sale by a manufacturer, distributor, or retailer shall not be in any42
way conditioned upon product registration."43
SECTION 2.44
(a)  This Act shall become effective on January 1, 2026.45
(b)  This Act shall apply to any warranty of an HVAC system or any component of such46
system manufactured and issued, sold, or offered for sale by a manufacturer, distributor, or47
retailer on or after the effective date of this Act and to any modifications or extensions of48
such warranties issued, sold, or offered for sale on or after such date.49
SECTION 3.50
All laws and parts of laws in conflict with this Act are repealed.51
