25 LC 49 2040 Senate Bill 152 By: Senators Dolezal of the 27th, Kennedy of the 18th, Gooch of the 51st, Robertson of the 29th, Brass of the 6th and others A BILL TO BE ENTITLED AN ACT To amend Article 2 of Chapter 2B of Title 20 of the Official Code of Georgia Annotated, the 1 "Georgia Promise Scholarship Act," so as to provide that the biological or adopted children2 of individuals who are foster parents and who meet certain conditions shall qualify for3 promise scholarship accounts; to provide for such conditions; to provide for definitions; to4 provide for related matters; to provide for an effective date; to repeal conflicting laws; and5 for other purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Article 2 of Chapter 2B of Title 20 of the Official Code of Georgia Annotated, the "Georgia9 Promise Scholarship Act," is amended by adding a new Code section to read as follows: 10 "20-2B-22.1. 11 (a) As used in this Code section, the term:12 (1) 'Biological or adopted child' means a child who is the biological issue of an13 individual or who has been adopted by an individual pursuant to a decree of adoption by14 a court of this state or by a court of any other jurisdiction.15 S. B. 152 - 1 - 25 LC 49 2040 (2) 'Foster parent' means an individual who provides care, lodging, supervision, and16 maintenance for one or more children in a foster care home used by an agency licensed17 as a child-placing agency pursuant to Chapter 5 of Title 49 or in a foster care home18 approved and directly supervised by the Department of Human Services.19 (b) Notwithstanding any provision of Code Section 20-2B-22 to the contrary, each student20 who has reached the age of four years but has not reached the age of 20 years, who is the21 biological or adopted child of an individual who is a foster parent, and who meets the22 requirements of paragraphs (1), (4), (6), (7), (8), and (9) of subsection (a) of Code Section23 20-2B-22 shall qualify for a promise scholarship account under this article."24 SECTION 2.25 This Act shall become effective upon its approval by the Governor or upon its becoming law26 without such approval.27 SECTION 3.28 All laws and parts of laws in conflict with this Act are repealed.29 S.
