25 SB 350/FA Senate Bill 350 By: Senators Jackson of the 41st, Mangham of the 55th, Parent of the 44th, Jones of the 10th and Anderson of the 43rd AS PASSED SENATE A BILL TO BE ENTITLED AN ACT To amend an Act providing for the compensation of certain county officers and officials of 1 DeKalb County, approved March 31, 1976 (Ga. L. 1976, p. 3986), as amended, so as to2 revise the compensation of certain judges, judicial officers, and county officers; to make3 conforming changes related to court names changed by general law; to provide for related4 matters; to provide for effective dates; to repeal conflicting laws; and for other purposes.5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 An Act providing for the compensation of certain county officers and officials of DeKalb8 County, approved March 31, 1976 (Ga. L. 1976, p. 3986), as amended, is amended by adding9 a new section to read as follows:10 "SECTION 1.2.11 Pursuant to Section 1 of an Act to amend Article 1 of Chapter 6 of Title 15 of the12 O.C.G.A., relating to general provisions regarding superior courts, approved May 6, 202413 (Ga. L. 2024, p. 738), as of January 1, 2025, the Stone Mountain Judicial Circuit shall be14 known and may be referred to as the DeKalb Judicial Circuit. Any reference in this Act15 S. B. 350 - 1 - 25 SB 350/FA to the Stone Mountain Judicial Circuit shall be deemed to refer to the DeKalb Judicial 16 Circuit."17 SECTION 2.18 Said Act is further amended by revising Sections 2 and 2.1 as follows:19 "SECTION 2.20 Notwithstanding any other provisions of law to the contrary, the annual salary of each of21 the officials of DeKalb County listed below shall be the following percentages of the gross22 salary as defined in Section 1: 23 (1) Judge of the Probate Court..................................................................................95% 24 (2) Clerk of the Superior Court.................................................................................80% 25 (3) Tax Commissioner...............................................................................................80% 26 (4) Judge of the Juvenile Court..................................................................................95% 27 SECTION 2.1.28 Notwithstanding any other provisions of law to the contrary, the annual salary of each of29 the officials of DeKalb County listed below shall be the following percentages of the gross30 salary as defined in Section 1:31 (1) Chief Executive Officer......................................................................................100%32 (2) Members of the Board of Commissioners..............................................................32%"33 SECTION 3.34 Said Act is further amended by revising Sections 3 and 3.1 as follows:35 S. B. 350 - 2 - 25 SB 350/FA "SECTION 3. 36 Notwithstanding any other provisions of law to the contrary, the annual salary of each of37 the officials of DeKalb County listed below shall be the following percentages of the gross38 salary as defined in Section 1:39 (1) State Court Judge, Divisions A and B……............................................................95% 40 (2) State Court Solicitor...............................................................................................95% 41 (3) Chief Magistrate.....................................................................................................95% 42 (4) Associate Magistrate...............................................................................................85%43 (5) District Attorney....................................................................................................100%44 (6) Sheriff…………………………………………………………………………...100%45 SECTION 3.1.46 (a) The annual salary of the Clerk of the State Court of DeKalb County shall be 90 percent47 of the annual salary received by the Clerk of the Superior Court of DeKalb County.48 (b) Each part-time associate judge of the Magistrate Court of DeKalb County shall be paid49 an hourly rate commensurate with the annual salary provided in this Act to a full-time50 associate judge of the Magistrate Court of DeKalb County."51 SECTION 4.52 Said Act is further amended by adding a new section to read as follows:53 "SECTION 3.2.54 Each judge of the State Court, Magistrate Court, Probate Court, or Juvenile Court of55 DeKalb County and each non-judicial official who pursuant to this Act receives any56 compensation from DeKalb County funds shall also receive from DeKalb County the same57 fringe benefits provided to all county employees, including but not limited to health58 insurance, dental insurance, vision insurance, life insurance, flexible benefits, incentives,59 S. B. 350 - 3 - 25 SB 350/FA and longevity pay. Each judge or official may opt out of any such fringe benefit. Such 60 fringe benefits shall be calculated based upon the total years of service that the judge or61 official has provided as a judge, official, or employee of DeKalb County and shall be62 calculated based upon the judge's or official's total compensation from state or DeKalb63 County funds. Nothing in this section shall be construed to modify or affect any pension64 or retirement plan."65 SECTION 5.66 (a) Except as provided for in subsection (b) of this section, this Act shall become effective67 on June 1, 2025.68 (b) Sections 2 and 3 of this Act shall become effective on August 1, 2025. 69 SECTION 6.70 All laws and parts of laws in conflict with this Act are repealed.71 S.
