25 LC 52 0705 Senate Bill 91 By: Senators Tillery of the 19th, Watson of the 1st, Hatchett of the 50th, Kirkpatrick of the 32nd, Goodman of the 8th and others AS PASSED SENATE A BILL TO BE ENTITLED AN ACT To amend Part 1 of Article 1 of Chapter 18 of Title 45 of the Official Code of Georgia 1 Annotated, relating to the state employees' health insurance plan, so as to prohibit the Board2 of Community Health from entering into, executing, or renewing a contract or contracts with3 any pharmacy benefits manager that owns or has an ownership interest in any retail4 pharmacy or any legal entity that contracts with or uses such pharmacy benefits manager; to5 provide for related matters; to repeal conflicting laws; and for other purposes.6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:7 SECTION 1.8 Part 1 of Article 1 of Chapter 18 of Title 45 of the Official Code of Georgia Annotated,9 relating to the state employees' health insurance plan, is amended by adding a new Code10 section to read as follows:11 "45-18-6.2. 12 (a) On or after July 1, 2025, the board shall not enter into, execute, or renew any contract13 or contracts to provide benefits under the plan of health insurance benefits in accordance14 with this part with:15 S. B. 91 - 1 - 25 LC 52 0705 (1) Any pharmacy benefits manager that owns or has an ownership interest in any retail16 pharmacy; or17 (2) Any legal entity that contracts with or uses any pharmacy benefits manager that owns18 or has an ownership interest in any retail pharmacy.19 (b) This Code section shall not be construed to impair any contracts in existence on20 June 30, 2025."21 SECTION 2.22 All laws and parts of laws in conflict with this Act are repealed.23 S.
