25 LC 49 2150 Senate Resolution 52 By: Senators Dolezal of the 27th, Still of the 48th and Anavitarte of the 31st A RESOLUTION Proposing an amendment to the Constitution so as to provide that the General Assembly may 1 by general law authorize local boards of education to impose, levy, and collect development2 impact fees and use the proceeds to pay for a share of the cost of additional educational3 facilities; to provide for the submission of this amendment for ratification or rejection; and4 for other purposes.5 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:6 SECTION 1.7 Article VIII, Section VI of the Constitution is amended by adding a new Paragraph to read8 as follows:9 "Paragraph V. Development impact fees for educational purposes. The General 10 Assembly is authorized to provide by general law that each local board of education may11 by resolution impose, levy, and collect development impact fees within any area of its local12 school system which is experiencing new growth and development. A county or13 municipality that has received a local board of education resolution imposing a14 development impact fee shall collect such fee as a condition of development approval by15 such county or municipality. Proceeds of any development impact fee imposed pursuant16 to this Paragraph shall be used to pay for a share of the cost of additional educational17 S. R. 52 - 1 - 25 LC 49 2150 facilities to serve new growth and development in the same area in which such fee is18 imposed."19 SECTION 2.20 The above proposed amendment to the Constitution shall be published and submitted as21 provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the22 above proposed amendment shall have written or printed thereon the following:23 "( ) YES24 25 ( ) NO26 27 Shall the Constitution of Georgia be amended so as to provide that the General Assembly may by general law authorize local boards of education to impose, levy, and collect development impact fees and use the proceeds to pay for a share of the cost of additional educational facilities?" All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." 28 All persons desiring to vote against ratifying the proposed amendment shall vote "No." If29 such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall30 become a part of the Constitution of this state.31 S.
