A BILL FOR AN ACT

 

 

RELATING TO TRANSPORTATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

      SECTION 1.  Section 263-9, Hawaii Revised Statutes, is amended to read as follows:      "§263-9  Dangerous flying a misdemeanor; penalty.  Any aeronaut or passenger who, while in flight over a thickly inhabited area or over a public gathering within the State, engages in trick or acrobatic flying, or in any acrobatic feat, or engages in or facilitates flying without a valid pilot license, or flies, except while in landing or taking off, at such a low level as to endanger the persons on the surface beneath, or drops any object except loose water or loose sand ballast, or paper handbills, shall be guilty of a misdemeanor and punishable by a fine of not more than $1,000, or imprisonment for not more than one year, or both.      For the purposes of this section, "pilot license" means a certification or student certification issued or recognized by the Federal Aviation Authority under title 14 Code of Federal Regulations part 61."      SECTION 2.  New statutory material is underscored.      SECTION 3.  This Act shall take effect on January 1, 2050.
