A BILL FOR AN ACT

 

 

relating to service animals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

      SECTION 1.  Chapter 521, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:      "§521-A  Tenant to disclose service animal.  (a)  A tenant shall disclose to the landlord their ownership of a service animal that will be living with the tenant prior to entering into a rental agreement.      (b)  A landlord shall not refuse tenancy based on a tenant's ownership of a service animal.      §521-B  Landlord's remedies for tenant's failure to disclose service animal.  If the tenant fails to comply with the disclosure requirement specified in section 521-A, the tenant shall be liable to the landlord for $100 plus reasonable attorneys fees."      SECTION 2.  Section 521-8, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:      ""Service animal" means the same as defined in section 347-2.5."      SECTION 3.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.      SECTION 4.  New statutory material is underscored.      SECTION 5.  This Act shall take effect upon its approval.      INTRODUCED BY:   _____________________________
