A BILL FOR AN ACT

 

 

RELATING TO EMERGENCY POWERS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

      SECTION 1.  Chapter 127A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:      "§127A-    Medical facilities; elective surgeries.  (a)  In the event that the governor declares a state of emergency for the entire State or any portion thereof, or a mayor declares a local state of emergency for the county or any portion thereof, or when the State, or any portion thereof, is the subject of a health or pandemic emergency:      (1)  The governor shall ensure the continuity of service by  medical facilities, both publicly and privately owned, by regulating the continuation of services; and      (2)  Any hospital, in its discretion, may suspend providing  elective surgeries to address operational limits of the facility's bed capacity.      (b)  As used in this section, "hospital" means a facility licensed under section 321-14.5."      SECTION 2.  New statutory material is underscored.      SECTION 3.
