A BILL FOR AN ACT
relating to jail diversion.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Pursuant to the "District Court, First Circuit, Misdemeanor Post-Booking Jail Diversion Program" memorandum of agreement executed in February 2023, the department of health shall, for all eligible participants in the district court jail diversion program, conduct the following: (1) An initial screening for possible serious mental illness; (2) If a possible serious mental illness is indicated by the initial screening, a mental health assessment; and (3) If a possible serious mental illness is indicated by the mental health assessment, a validated risk needs assessment. The department of health shall also determine for each eligible participant whether the criteria for further evaluation and possible emergency hospitalization pursuant to section 334-59(a)(3), Hawaii Revised Statutes, have been met and, if satisfied, follow the applicable statutory procedures.
